North Texas Municipal Construction Co. has agreed to our proposal (surprised??). I am faxing over a signed
copy of the agreement. It is probably illegible as by now it is a 3rd generation fax. North Texas is putting the
original in today's mail and we will make sure you get the original for your files.
Mike Daigre has asked that the City consider an interim pay request that releases all but the funds anticipated
to be deducted by proposed Change Order No. 6. This would include the $2,275 NTMCC has agreed to and
the anticipated SCADA System reduction at $500 per day. Assuming it will take Team Controls through the
weekend to correct their problems, the SCADA deduction could be as much as $3,000. Together the total
expected contract adjustment is in the range of $5,000 to $6,000.
As a reminder, Change Order No. 2 provided that the retainage on the primary contract work would be
reduced to no more than 1/2% (or eliminated) once the primary contract work was complete. The SCADA
System portion of the work would remain at a retainage of 5%. Following this approach the 1/2% retainage
on the primary contract work equals approximately $4,688 and the 5% of the SCADA portion equals $7, 787,
making the total amount retained $12,475.
