Gentlemen,
I am emailing you both in hope that you might be of some assistance. George Marshall and Larry have
supposedly charged Tiseo Paving $38,000.00 for liquidated damages on the Deforest Rd project. I am not
sure if anyone is aware of this, but Tiseo has charged the entire $38,000.00 to us thus putting us in
financial strain as this was over 10% of our contract. I understand the purpose of liquidated damages and
respect the role they play in protecting the owner against non-responsive general contractors. I can not
speak for Tiseo, but I know we were there working with at least a small crew everyday possible. We
completed our work and made every correction or addition asked by George or Larry. We were responsive
to the home owners along Deforest Rd and the adjacent sub-division and felt like, as usual, our work and
relationship with our clients was good if not excellent.
As I stated earlier, I cannot speak to the relationship the City had with Tiseo. I do know, that it has been
a long one. We do have a relationship with both of you gentlemen, so I am reaching out in hopes that
there still might be an opportunity to resolve this matter in a way that reflects the entire scope of the
project and not just the 38 days it has been determined to be late.
Finally, I would hope someone would consider the price at which we bid our scopes of work. I missed the
price of the retaining wall and would bet we were low on those two scopes by over $40,000 combined.
Tiseo is my largest client, so I am not wanting to rock the boat with them. My attempts to negotiate with
them have not been fruitful to say the least.
Any help you might be would be greatly appreciated.
