Subject: Performin/g'~king Lot & Other Change Orders
Please find attached the cost breakdown submitted by Keck & Company for the removal
and re-pour of the parking lot at the Arts Center. Keck & Company maintains that the
pre-existing underground water leaks caused the unaccepted parking lot condition and
therefore they should not be responsible for this cost.
Keck & Company also submitted a list of items they performed during this project over
and above contract specifications. The only item performed where Keck & Company
indicated that a change order would be necessaD~ is number one regarding painting of the
HVAC ductwork in theatre. The architects did not include this in the contractor's scope
and therefore a change order was requested by staff. All other items were performed with
the understanding that no change orders were necessary. Keck & Company is now
requesting compensation. These items should be discussed with Dave Burmah since it is
my opinion that compensation is being requested as a result of our recent letters
indicating liquidated damages are being considered.
Should the parking lot change order be approved, Keck & Company is prepared to begin
this work immediately under the supervision of Lar~' Davis. Please review this matter
and let me know how to proceed.
