Re: Univest Land Exchange and Surveys Around Town Center Complex
Dear Ed:
I am in receipt of your letter of November 5. In order to work out the land
swap with Univest, we will need to refer to the different areas of property which wiU
be involved. About the only way I know to accomplish this is to have the areas marked
on a plat which would be attached to the agreement. My previous suggestion to you
was that we meet with the surveyor you select so that we can describe to him the
various tracts that need to be surveyed. I also suggested that Councilman Wilkerson
might want to be involved in this meeting.
In my opinion, we will need to carefully describe to the surveyor the areas
involved because of the complicated nature of the adjustment.
What we have is an original 8-aere tract which was conveyed to the city by
deed. Later this 8-acre tract was shifted to the east 40 feet. The new agreement
would take the new 8-acre tract and divide it into four tracts or areas, one containing
5.316 acres, two tracts, one on each side of the 5.316-aere tract, each eontaining 1.049
acres and a fourth treat which is presently covered by the city's portion of Parkway
Boulevard containing .586 acres.
This would plaee the present City Hall Complex centered on the 5.316-acre tract
with a strip on each side, each containing 1.049 acres. It is my understanding that
the agreement would be that the eity would have the option at a later time to exchange
the two 1.049-acre strips of land for a 2.098-acre tract of land fronting on Hertz Road
and south of the lake being built by Univest south of the City Hall Complex. This
2.098-aere tract of land would be tentatively scheduled for the library.
I have suggested this preliminary meeting with the surveyor because of the
complicated nature of the transaetion, whieh I feel would be extremely difficult to
explain in a written memorandum without some oral input. Also, I have suggested that
Dean Wilkerson and his committee be involved because I do not have sufficient information
to tell the surveyor exactly where the 2.098-aere tract is to be located, and I do not
know what part of Parkway Boulevard is to be assigned to the .586-acre tract.

The agreement with Univest will be very simple to prepare, it is the description
of all of these various tracts which is eomplieated and will have to be worked out prior
to the preparation of the written agreement.
I think at this meeting we would need to have the surveys and platting documents
that were enclosed in the packet to you from Dean Wilkerson.
