Shared Utility Issues
Dear Mr. Grogan:
This letter is intended as a follow up to the several conversations and meetings that you and
your representatives have had in recent weeks with me and members of my Public Works staff
regarding the utilities serving the referenced property.
As you know, the property is comprised of three basic subparcels with three separate owners:
the "grocery parcel" owned by Albertsons, Inc.; the "retail parcel" owned by your partnership; and
the undeveloped parcel owned by an affiliate of the Connell Companies.
When this property was initially developed, the City (believing that the property would not
be subdivided) allowed a single water line loop to serve the needs of all three (3) parcels. The fire
water for each parcel is served by thc same line and, as you know, thc domestic water needs for the
retail parcel is also supplied by that same line. Albertsons's has their own separate domestic water
service. And, as it is still undeveloped, the remaining parcel is not yet connected for domestic use.
Today, we would never allow thc same water service plan. Moreover, we believe that the
water service for the property as a whole is in need of several modifications for efficient operation
mad maintenance in thc future as well as proper fire safety protections.
In addition to our suggestion that you either separate the domestic service for the retail parcel
from the fire loop (our preference) or adequately submeter your domestic linc so as to be able to
determine your actual domestic use from any fire usc, we feel quite strongly that a "Shared Use
Agreement" be executed by the three parcel owners and filed of record. This agreement would cover

issues of water usage costs, line repair and maintenance, and other matters. With such agreement
in place, we at the City will have dir~tion as to who to contact on issues relating m fire safety m-~d
the fire loop and be better able to monitor usage and problems.
We urge you to contact your neighboring property owners to reach an agreement on these
issucs privately so that we can continue maintaining the high lcvcls of rue ~fety and utility service
that we all desire. Your ability to deal with these matters among yourselves privately allows the City
to better fulfill its public mission with thc least amount of interference in' your business.
We appreciate in advance your willingness to look into these matters and look forward to
news of progress with your neighboring owners.
