Re: Water line connection - Denton Tap Development
Dear Mr. Lewis:
Skyhawk Venture is the owner of the 4.8229 acres of land known as Lot 3 of the Connell Skaggs Addition
to the City of Coppell, located on the north side of Sandy Lake Road just west of Denton Tap Road as
shown on the attached drawing, Exhibit "A" (the "Property"). Subject to your execution of this Letter
Agreement we hereby authorize you to connect to the existing water line on the Properly and to extend the
line as shown on the attached Offsite Water Plan, Denton Tap Development dated 11/97 and prepared by
Dowdey, Anderson & A~sociates, Inc., to our northern boundary. All work shall be accomplished across
the Property in accordance with City of Coppell code requirements.
Skyhawk Veniure grants you permission to enter upon the Property at all reasonable times and from time
to time for the purpose, at your risk, cost and expense, of installing the water line as discussed above. You
shall not cause or permit to be caused any damage tO the Property, and shall not create any liens against
the Property or Skyhawk Venture. Upon completion of the laying of the water line, you agree to
reasonably restore the property to its off, hal condition by grading and smoothing off the site, and any
other work required to restore the Property to a clean and safe condition. You agree also to indemnify and
hold Skyhawk Venture harmless again~ any liability and expense arising out of your enUy and work on
the Property. Before any work is commenced upon the Property, you will provide Skyhawk Venture with
a Certificate of Insurance showing proof of general liability coverage with limits of at least $1,000,000.00,
workers compensation with statutory benefits, and automobile liability with a limit of at least
$1,000,000.00. Skyhawk Venture shall be named as additional insured on your general liability coverage.
The mutual benefit derived by both Skyhawk Venture and you is deemed consideration sufficient to
support the Letter Agreement. Plea,se sign below acknowledging your agreement to the above, return the
fully executed original of this letter to me, and have the above discussed Certificate of Insurance
forwarded to me.
