It has been some time since we met in the last quarter of 1988, when
working on the Hager plat, and Royal Lane Extension projects. As I
recall, you said that when you complete those two projects, you would
pursue the construction of the drainage structure(s) just west of the
Connell Skaggs Addition. I was concerned about the situation, because
during the July 12, 1988, storm, property had flooded along Shady Dale
Lane. At a later time, you said something about needing easements. Have
you gotten them yet?

I have heard since then that there was some residential flooding.
Likewise, it has come to my attention that per the attached letter, dated
May 20, 1987, to Wayne Ginn, P.E., the City Engineer at that time, that
was part of the City Council request packet for subject plat, you committed
to building the drainage structure(s) "simultaneously with the school
construction of same, and according to City Specifications".
Therefore, since the school construction is nearing completion, the
drainage structure(s) shall be constructed. Please forward three (3) sets
of construction documents for review and approval.
When those sets are finally approved, it will be necessary to submit at
least six (6) sets of construction documents for final review and stamped
approval.
All applicable fees and documents (i.e. proposed pro-rata agreement)
related improvements, should accompany your submittal package for approval.
Please let me know if there are any questions.

Conne!l Develo~nent Co. plans to construct the Connell Skaggs Addition,
which %&ll be a re~il center located on the tract of lard at the northwest
corner o£ Sa~y Lake Road and Denton Tap Road. The center will consist of a
Skaggs ~]~rmarket, an F~xon service station and a num~oer of specialty retail
skops. The enc].os~l preliminary Site Plan for this site (P~oell & Powell
Drawing No. S-1311.2, dated Octci~r, 1985) shows the proposed site.
As part of the development of this project, we have agreed to construct a
concrete-lined open channel alo~j the ~st line of the project, and an earthen
open channel north of the property to the existing gravel road which runs east
a~t west along the north line of Shadydale Acres. This channel is required to
c~onvey drairu%ge fr~t south of Sandy Lake Road north to Cottonwood Branch.
The proposed channel is to be_ partially located on the Connell Skaggs site
aP~ partially in a 20-foot drainage and utility easement located along the
easter.~w~zt 20 feet of the S~hadyda!e Acres ~dition. This easement '~s
dedicat~l by the Final Plat of Shadydale Acres recorded in Volume 42, Page 95
of the Deed Records of Dallas County, Texas. This easement has been dedicated
for public use for the purposes of constructing and m~intaining drainage and
utility improvements.
The construction of this channel will require the relocation of fences and
sheds located in and along the drainage easement. We will replace the fences
and relocate the sheds out of the construction area, as well as landscape the
area to City Landscape Ordinance requirements at our cost.

Dear Wayne:
The attached Agreement with the City of Coppell outlines specifically
the manner and terms under which Connell Development Company will agree
to construct a box culvert along the westerly side of the referenced
site. The Agreement specifies that at such time as the City Engineer
believes that the box culvert is necessary to handle on-site and/or
off-site drainage, and upon City Council approval, CDC will agree to
construct the box.

downstream. With regard to this situation, and keeping within the
intention of the Agreement, we propose the following:
Connell Development Company will agree to construct the box culvert
simultaneously with the school construction of same and according
to City specifications. In light of the relatively short time period
involved, we would ask that the requirement for a letter of Credit
be removed from the Agreement and that the City accept our written
Commitment. The pro rata reimbursement to Connell from the downstream
owners would remain as originally agreed upon and become due and
payable on platting or conveyance.
There is much common sense in coordinating our efforts with the school,
and should be substantial savings to both parties by building the box
culvert simultaneously.
