Gentlemen:
You have previously received our Notices under Article 5160
specifying the claim of our client, Blackmon Electric Company.
Thus far, we have had no indication of when this payment might be
forthcoming to our client.
Obviously, this amount of money is very critical to Blackmon
Electric and they have requested that we proceed immediately
toward its collection. We understand that the usual response is
to refer the claimant to the principal, but I must tell you that
our client has attempted on many occasions to contact Howard U.
Freeman and that such attempts have been unsuccessful. In fact,
we have word that the general contractor intends to avoid
conversations with or responding to Blackmon Electric.
We therefore request that Aetna honor its obligations in this
matter by remitting payment of our client's claim forthwith.
Otherwise, our client will have no choice but to institute
legal proceedings against all responsible parties for the full
amount of the debt, plus interest, court costs and attorneys'
fees. We certainly hope that you will use your good offices to
quickly resolve this matter so that the further expense and effort
involved in litigation may be avoided.
