Box 478 Coppell, Texas 75019 RE: Coppell Town Center Project No. 8457 Dear Ed: On Thursday, July 10, 1986 at 11:15 a.m. during a telephone conversation concerning the above referenced project you advised our office of the following information. 1. On July 7, 1986 the Coppell City Council met and discussed the extension of the Owner/Architect Agreement to provide architectural ahd engineering services until such a time as the General Contractor completes all work on the above referenced project. The City Council voted not to extend the services of O'Brien O'Brien Callaway nor it's consultants past the present July 6, 1986 contractual agreement date stating that the City of Coppell and it's representa- tives would provide any and all services related to the close-out of this project. 2. You advised that you being the duly authorized representative for the City of Coppell would work directly with the General Contractor from this date forward in the completion of this project and that no further contact would be necessary between O'Brien O'Brien Callaway and the General Contractor, Howard U. Freeman, Inc. Any outstanding items would be resolved directly between the Owner and Contractor. 3. You advised that during the Council meeting of July 7, 1986 that the City Council concurred with our opinion, and in keeping with the OWner/Architect Agreement the termination date of our contract was to occur not later than July 6, 1986 and that our contract was for a specific duration of 24 consecutive calendar months ending not later than July 6, 1986. 2850 Lincoln ~aza · 500 North Akard · LB 16 · Dallas, Texas 752~-3394 · (~4) 954-~00 McKinney Place · 3~1 McKinney Avenue · Sui~ 850 - LB ~3 · Dallas, Texas 75204 · (214) 8~-~00 Mr. Ed Powell 14 July 1986 Page Two In complying with the direction which has been provided to O'Brien O'Brien Callaway as stated above, we will notify our consultants of the City of Coppell's decision and directions and it is understood that O'Brien O'Brien Callaway and it's consultants have fulfilled their contractual obligations. Should the services of either O'Brien O'Brien Callaway or any of it's consultants be required in the future by the City of Coppell, a separate additional services agreement will need to be executed prior to commencing any further work. As I requested during our telephone conversation of July 10, 1986, a formal written notification is requested by our office from the City of Coppell outlining the direction you have verbally given us as I have stated above. It is requested that this formal written notification be received in a timely manner, but as you are the duly authorized representative of the- City of Coppell, we are presently complying with the verbal direction which you have given O'Brien O'Brien Callaway and have ceased services effective July 7, 1986.
