This will confirm that Home Interiors & Gifts, Inc. ("HIGI")
will accept the revised form of Perimeter Facility Agreement
prepared by Pete Smith conditioned upon approval of the plat
submitted by HIGI. As you may be aware, HIGI plans to seek P & Z
approval of the plat with a condition attached to the use of the
sewer easement on the south side of the property.

PERIMETER FACILITY AGREEMENT
THIS AGREEMENT is made and entered into this day of
,1993, by and between the City of Coppell, a municipal corporation
hereinafter referred to as "City" and the undersigned, who is the owner of the hereinafter
named subdivision, hereinafter referred to as "Owner".
WITNESSETH:
WHEREAS, heretofore, Owner has submitted a plat map of Coppell Commerce
Center, Lot 3, Block 4, an addition to the City of CoppeI1, Texas; and
WHEREAS, the improvement of Coppell Road or the escrow of funds to pay the cost
of the future improvement of same is a prerequisite to the approval of said plat;
WHEREAS, City and Owner have agreed to enter into this Agreement in lieu of
Owner being required to improve Coppell Road or escrow funds to pay the cost of the
future improvement of same:
NOW, THEREFORE, City and Owner do hereby agree that Owner is hereby relieved
of the responsibility of either immediately improving Coppell Road or escrowing funds to
pay the cost of same as a prerequisite to the approval and filing of such final plat map.
However, Owner shall pay to the City of CoppelI its pro rata share of the costs of
construction at the time the road is to be improved in an amount consistent with the
ordinances of the City of Coppell, Texas.
It is further agreed and understood by the parties that this agreement sh',fll constitute
a negative covenant running with the land and shall be enforceable by the City of Coppell
against Owner, its successors, assigns, and transferees.
IN TESTIMONY WHEREOF, the parties to the Agreement, have hereunto set their
hands the day and year above written.

AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING CHAPTER 18 OF THE
CODE OF ORDINANCES OF THE CITY OF COPPELL TO PROVIDE FOR GENERAL AND
SPECIAL FEES AND CHARGES TO BE ASSESSED AND COLLECTED BY THE CITY AS
AUTHORIZED BY THIS OR OTHER ORDINANCES OF THE CITY; PROVIDING A
REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL,
TEXAS:
SECTION 1. AMEND CHAPTER 18 OF THE COPPELL CITY CODE
Chapter 18 of the Code of Ordinances of the City of Coppell is hereby amended to read as
follows:
CHAPTER 18
GENERAL AND SPECIAL FEES
ARTICLE 18 - 1 GENERAL PURPOSE
WHEREAS, the City of coppell wishes to adopt a special chapter for the purpose of setting
forth the majority of fees and charges to be assessed and collected by the City so that reference may
be made to the fees so named without specifically stating the amount of fee in the basic ordinance
calling for a charge; and
WHEREAS, the purpose of this chapter to list such fees and charges but it is not the intent
of this chapter to amend or change any fee heretofore established or that may hereinafter be
established that is not provided for in this chapter; and
WHEREAS, in the event there is a conflict between a fee established in this Chapter and the

SECTION 2. REPEALING CLAUSE
All parts of ordinances, inconsistent or in conflict with the provisions of this ordinance are hereby repealed.
SECTION 3. SEVERABILITY CLAUSE
If any article, paragraph or subdivision, clause or provision of this ordinance shall be adjudged invalid or held
unconstitutional, the same shall not affect the validity of this ordinance as a whole or any part or provision
thereof, other than the part so decided to be invalid or unconstitutional.
SECTION 4. EFFECTIVE DATE
This ordinance shall take effect September 21, 1992.
