Dear Mr. Griffin:
In the conveyance from St. Louis Southwestern Railway in 1991, DARTPAC
acquired an approximately 100' x 1,000' parcel outside the mainline
rail corridor. This rail corridor is not currently within DART's
operating system plans.
Future use of this rail corridor for mass transit will include
multiple tracks (mass transit and freight) with ditches along either
side. At that time DART will be addressing relocation of existing
utilities parallelling the right of way. While DART has no objection
to utility crossings of the railroad right of way, we are reluctant to
grant permission to occupy the corridor because of these future plans.
Of course, there are no plans at this time for this outer parcel.
However, we do not deem it prudent to encumber the property until we
are ready to develop as this site could be considered for a transit
facility.
Should public street right of way or an alternative route not be
available to the City for its utilities, DART, desiring to be a good
neighbor, would be willing to consider a proposed route along the
property line. The permission to use DART property would be in the
form of a license agreement subject to termination and relocation with
annualized rental as consideration based on the area and fair market
value.
While this may not be as definitive an answer as you desired, please
understand that our plans for use of the property have not been
defined.
