Scott Ozymy Koll Corporate Development 8411 Preston Road, Suite 700 Dallas, TX 75225 T H E C I T Y 0 F COPi ELL December 14, 2000 RE: Koll Center (adjacent to Freeport Parkway) Dear Mr. Ozymy: This letter is written as a follow-up to your November 27, 2000 letter requesting credits for the value of right-of-way dedicated adjacent to Freeport Parkway. Included with this letter is a copy of a Development Agreement that establishes the guidelines for the Roadway Impact Fee credit to be allowed against your development. There are several items in the Development Agreement highlighted in yellow which need additional clarification from you. One is the date on which the right-of-way will be dedicated by plat. The second is the actual value of the right-of-way both on a square foot basis and a total basis. The third is the actual contact person for Koll Corporate Development. In your November 27th letter you provided information about the value of right-of-way; however, a value of $2.75 is substantially higher than values of right-of-way dedication that we have seen in other areas. A similar credit against Roadway Impact Fees was provided for property along Bethel Road just west of Freeport Parkway. The value of that right-of-way was approximately $1.30/per square foot. I have also purchased right-of-way throughout the City of Coppell on various roadways and have generally paid in the neighborhood a $1.50 to $2.00/per square foot. If in fact $2.75/per square foot is the actual value that you paid for the property then please provide additional information so that it can be placed as backup in our file to substantiate the value of the credit as provided in the Development Agreement. It should also be noted that the Development Agreement set up a credit against only Roadway Impact Fees not against other fees i.e., water, sewer, building permit, etc. Once the Development Agreement is finalized between yourself and the City, it will need City Council action for approval. The next City Council meeting is January 9, 2001. To be placed on that agenda for approval I will need all items associated with the agreement resolved by December 22, 2000. If that deadline is not met, the next City Council meeting is January 23, 2001 and I will need all items resolved by approximately January 5, 2001 to be place on the agenda for that meeting. Box 478 Coppell, TX 75019 RE: Koll Center Coppell Dear Ken: The above referenced project was approved by the City Council on November 144. As we discussed, Koll will deed the required right-of-way for the expansion of Freeport Parkway in lieu of reduced City impact fees customarily charged to the project. The value of the land required for the right-of-way is approximately $50,520, based on 18,370.95 square feet of land area (1,224.73 feet x the 15 foot R.O.W.) along Freeport Parkway per the attached survey. As I understand it, this amount will be established as a credit against the first amounts due to the City. Any further reductions in the cost of impact fees or permits that you can offer as an incentive for development would be helpful.
