Dear Mr. Procter:
During the Gity Council workshop held on January 21, [986 there was
a discussion regarding the extension of PVC sleeving at the median
opening north of the project site. During this discussion, Councilman
Ware and Councilman Smother~n expressed their concerns regarding
this item and it was stated it appeared that the Architect may in
some way be responsible for, and I quote, "dropping the ball" on this
item by not incorporating this item in the plans for construction.
We were further advised by the Council that we should have verified
with the City of Coppell, by reviewing the pertinent plats on file,
the utilities currently in place in this median strip. At that time
it was apparent that the City Council was not fully informed on the
entire matter, nor did they know the past factual history which would
bear on a resolution to this item. Rather than enter into further
discussions, we felt it best to gather pertinent information which
would address the specific comments made by the City Council.
I provide herewith the following for your review, information, and
presentation to the City Council.
i. It is important to note that Mr. Wayne Ginn of Ginn, Inc. Consulting
Engineers was, during the entire design, construction document, and
construction phase to date, the acting City Engineer and representa-
tive of the City of Coppell for this project.
2. The firm of Ginn, Inc. Consulting Engineers was retained by the City
of Coppell to act as civil engineers for the Tom Center project and
provided the Architect, O'Brien O'Brien Callaway, with civil engineer-
ing services at the City's direction. Civil engineering services
were excluded from the O~er/Architect Agreement and were paid for
directly by the City of Coppell.

3. Attached herewith is a print of the preliminary final plat, the
Grading, Drainage, and Utility Plan as prepared by Davis Land Surveying
Company, Inc. dated 1-9-85, noting the Property Owner as the City
of Coppell and the Engineer of Record as Ginn, Inc. This pre-
liminary plat is, to the best of our knowledge, the document the
City of Coppell had on file during the design phase of the Town
Center project. This document was provided to our office by the
City ~f Coppell and the Civil Engineer to be incorporated into
the construction documents for this project.
4. Attached herewith is Sheet No. G-! of the construction documents
.for this project which uses the preliminary final plat referenced
in Item 3 as the Grading, Drainage, and Utility Plan for the Coppell
Town Center project. This plan, as stated before, was provided by
the Cit~ of Coppell and the Civil Engineer.
5. Please refer to the documents noted in Items 3 and 4 and note that
in the area of the center median of Parkway Blvd. north of the project
site that no Sleeving or utility lines are indicated. Notes have
been made giving the General Contractor a clear direction on the work
to be accomplished under his contract and since the document, which
was received from the City of Coppell and the Civil Engineer indicated
no utility sleeves in this area, no provisions for extension of such
sleeves were made.
In conclusion, it should be noted and duly recorded that O'Brien O'Brien
Callaway, Architects of Record for the Coppell Town Center Project, has
consistently acted in the best interest of the City of Coppell and in no
way "dropped the ball" on this item as Councilman Smotherman stated.
