Dear Mr. Anderson:
As you are aware, our client, CMC Commercial Development, is developing Highpoint
Oaks in Lewisville.
This tract is directly noah of The Greens of Coppell, for which your firm prepared
infrastructure plans. On September 18, 1998, you and I met with Mr. TS Kumar of the
City of Lewisville, Mr. Ken Gdffin of the City of Coppell and the developer of The Greens
to discuss grading, drainage, retaining walls and screening along the common property
line.
It was our understanding that you were to contact us to indicate a requested outfall
location and elevation for the discharge from the drainage area which enters The
Greens approximately 600 feet west of Denton Tap Road. In addition, your client was
to provide a proposal regarding the construction of the retaining wall at the northeast
corner of The Greens. This proposal was to include: timing of construction, height of
wall, structural design of the wall, and set backs on Highpoint Oaks from the wall.
Since that meeting, we have made numerous attempts to contact your office regarding
a resolution of these items. To date, you have not returned our calls nor contacted us
regarding these items.
We have begun construction on the Highpoint Oaks development and wish to make you
aware of the following items:
1)
We will discharge drainage from Highpoint Oaks as indicated on our
current plan. The major concentration will be at the location of the
discharge from the existing lake on Highpoint Oaks site. The quantity
of discharge will not exceed that identified in your drainage area map for
The Greens. If you wish to modify this location, please contact us within
one week.
2)
Since the Greens development has modified grading along the north line
of that development, it is our opinion that it is their responsibility to
provide a wall which does not have a negative impact on the Highpoint
Oaks development.

Please note that Highpoint Oaks is a commercial development with no setbacks
required along its south property line. We would expect that any wall along the
common line which is required as a result of grading on The Greens development
will be constructed as to not have a negative impact on. the development of
Highpoint Oaks. If you wish to contact us regarding this item, please do so within
one week.
If we have not heard from you regarding these items within one week from this letter, we will
assume that you have no comments regarding these items and proceed with our construction. If
you have any questions or need any additional information, please do not hesitate to give me a call.
