Dear Bill:
On Friday, September 4th., you and I met with the developer of the Greens project
located immediately south of the Highpoint Oaks project. The purpose of this meeting
was to discuss grading and drainage issues along the common property lines between
the two developments. Based upon the result of this meeting, we offer the following
understanding:
We will modify our proposed mass grading plan to include .discharge
swales located along the western portion of your north line. These
swales would collect discharge from the Highpoint Oaks property and
discharge it at its current discharge Point.
As we discussed, our plans were currently scheduled to be approved at
the October 7th Lewisville P&Z meeting. It is our understanding that this
meeting date has been pushed back approximately one week due to city
conflicts and our plans are anticipated to be approved on the October
13th P&Z meeting. Your development indicates the construction of a wall
along the eastern portion of your north property line. This wall as we
understand it, is approximately 2-8 feet high and is not designed to carry
any surcharge loading from automobile parking lots or drives which
would be constructed on the Highpoint Oaks property immediately
adjacent to the wall. In addition, we are constructing a sanitary sewer
located north of this wall which would be approximately 20-30 feet deep.
You expressed concerns regarding the stability of the wall during these
processes and we concur. We would therefore request that you would
delay the construction of this wall until approximately the first week of
November. During this time as we can complete grading and sanitary
sewer installation operation in the area immediately north of the wall. In
addition, we would request that you review the structural capacity of the
wall to provide additional surcharge loading which would allow the
construction of a parking lot north of the wall. In retum, we will agree to
cut the grade at the existing property line along the length of this wall
approximately two feet, reducing your height of your proposed wall.
