RE: The Courtyards of Riverchase

At the July 7, 1994 Development Review Committee meeting, we discussed a plat that is located
between Riverchase Drive and the railroad. During some recent research on the maintenance
of the MacArthur medians, I read the original zoning requirements of the Riverchase
development. A letter dated February 25, 1985 from Terra Land Development Company was
attached as Exhibit 'B' to the zoning ordinance. That particular letter states that Terra will add
a second access road to Beltline Road when the crossing is obtained from the St. Louis and
Southwestern Railroad. This is the street that is referred to as Fairway Drive on the
Thoroughfare Plan. Also, the letter states that Terra will provide landscaping along the southern
railroad right-a-way and Beltline Rd. During the review of the plat, I made comments that those
items would need to be resolved.
At the Development Review Committee meeting, Jerry Ragsdale, of Republic Property, stated
that they have reviewed the original zoning ordinance and their attorneys have interpreted it to
state that Terra Land Development Company is responsible for the referenced items, no matter
who the future owner or owners may be. It was his attorneys' opinion that this requirement did
not run with the land, but was required only of Terra Land Development Company.
I have previously provided you copies of the zoning ordinances and the Home Owners
Association documents when you were evaluating the maintenance of medians in MacArthur
Blvd. The information I am referring to should be in that packet.
If possible, prior to the Planning and Zoning meeting of July 21, 1994, I would appreciate al~/~-IFI~'
