You can bet, the mini-mansions will take a dive in value, when a potential buyer pulls up and listens to the noise on the outside of the Shadydale acres properties...and the Semi's tooling through from I-35-day and night. Remember, we are tripling in population or doubling...depending on what poll. _______________/ 101 Easement; City Easement was granted for the right of way to the city of coppell for an expensed amount under non-disclosure, otherwise imminent domain would have been the next step by the city...and they would have won...I checked with A&M as well as the State of Texas...(attorney review) Oncor Easement was NOT granted right of way easement for placing lines over the property boundary on 101 Oak Trail, because they would want another 15' setback to butcher the trees at will, with no compensation...and NOTHING can be under those lines, per Oncor. The sidewalk that has been placed by the city, is not the "finished" sidewalk...and because Oncor would not run underground lines due to "cost" they now will be making decisions by having been granted city easement rights to place poles and lines in the city easement, without compensation. ________________/ sorry folks, tough times right now, Had I been smarter, that would have been caught as an exception in the final dox on the easement granted. Shame on the attorney review. I have negotiated commercial easements and restrictions have been embedded- no further utility easements, unless negotiated with owner..another words, the city bought the ground rights and need to review the docs for air rights also on the easement. With power lines, a wall may not be able to be placed "under the lines", if the city has granted Oncor full access to the easement. So the wall cannot be on the property line or city easement. ______________/ 1 Coppell Engineering Keith Marvin would know, and I invite him to chime in to all of the above, the city will not allow a masonary wall easement - for a barrier masonary wall and may request a major setback easement on 101 Oak Trail for such a masonary wall....then, another major set back when a new build is placed on the property. (I have an 8,000 sf home drafted-Contemporary for some future date) The group's original email was sent on to Keith in City Engineering, for thoughtful review....and a cc on this one also. ______________/ History 101 Oak Trail has taken the brunt of the city flooding, prior to reaching North Oak Trail...to the extent of the property "waving", it was so saturated, while other properties stayed on high ground....eroding soil, dying oak trees...penetrating the garage area, rotting the fencing. 101 Oak Trail has taken the brunt of trespass of minors, adults, dogs, runners, bicycle riders, four and two wheel vehicles trespass through the two lane 118' drive...cutting the corner from Oak Trail to Sandy Lake. I am mounting cameras in the trees through friends in the security business and turning over pictures to the local police ....when people start walking down a sidewalk 120' back from Oak Trail, football players standing on my front porch and believe they have the right to trespass, breaking into the back yard, we have a very sick society. Many are my neighbors, and their minors...therefore, I will only grant an easement which makes sense, and if every one of my neighbors will agree to a compound wall surrounding the entire 101 Oak Trail property....it is absolutely insane to live on the corner and grant an easement of the magnitude that is being requested so lightly in property value (did you all know what the value of Oak Trail dirt or Shadydale Acres is worth???) as to trespass...just watch the trespass, if in fact you have not yourself. Ask Dennis Moss, my good neighbor and buddy of 15 years. Ask Keith Marvin. How much fun to stand in a driveway with a car whizzing by with one of the local shadydale teenagers almost taking off a door. ________________/ This is not a simple matter of Shadydale Acres - "great, we will all chip in $$$ and oh by the way, frontage property owners will grant easement". "granting easement comes with set backs". I am sure that Beas is unaware of this issue. ________________/ Keith Marvin will tell you, you must go through variance for the fencing...I did and was turned down...and two properties away - North on Oak Trail, have a completely fenced in yard....I was deceived by a member of the building permit of coppell who flat lied in the hearing....and later told me, He works for the city...he is not under oath. The building variance department fencing review employee said everyone knows the property has major trespass...and he off the record, would make recommendation for a total fencing. _________________/ I have witness my dear neighbors...and was told if i signed off on the easement quickly...would be favorable about the fencing due to trespass... (this was not Keith Marvin, Keith is a pretty fair guy, I asked once if another easement could be granted, but should have made a condition, as I wanted the electrical lines which have power surges along Sandy Lake buried...I buried 101's to the line"...when trees started sparking) ____________/ I realize that most of you are the barons of society in coppell, perhaps money - greater than I have to commit...shall win the day...or a darn good lawyer...the real estate attorneys I deal with are mostly corporate or REO...would you all like to purchase the corner for a real tribute to the city as a small park???? _______________/ I travel between Dallas and Florida (a home on a private golf course). Love Dallas and plans to build the contemporary are no longer on the corner 101 lot. Not sure where we will go with the property. Believe I am quite reasonable, however, believe that dollar, sense and property values are now being thrown around and very true, the value is decreasing with the widening and noise level of sandy lake road, do you hear the woosh of your pockebook..smart people will sell out and move to the 5 acre parcels while they can around the corner 2 Therefore, unless Keith can help - believe the city could allow a wall easement on their purchased property where the wood fence line was hastily erected ....with no one knowing the truth of the matter, including me...ask a Keith Marvin if the city cares about you, about safety, about extending easement for a wall...that is the approach...and i will tell you, get an attorney...if you decide for any type of review, tape record the meetings, become smart about this subject... ______________/ prior to everyone who jumps up and down, would you grant an masonary wall set back easement with another 15' build set back - 120' in length...??? on your personal property...anyone have a calculator...$$$$$ _______________/ The city told me to plant a natural barrier (plants)...if I want a wall...and no, they do not really care about the safety...vehicles and commercial trucks traveling 45-50 miles an hour, you do the math....trying to run the red light at whispering hill....minors are being hurt...this part of sandy lake should not have ever been granted multiple lanes...it was not really needed with other thoroughfare...ALL THINGS COULD HAVE BEEN MODIFIED...we opened the door to large distribution trucking from I35 to I121 and the large distribution centers...that is what pays coppell taxes...not the mini- mansions of Shadydale Acres. Have thought of a Hacienda type home on the corner with block walls, think it may keep a semi from jumping the curb? _______________/ I may trade the easement land for some of Dennis Moss 1 acre parcel of untouched, oak tree land, how about it Dennis, want to grant 15' and a set back? Included are the responses as follows: IN FAVOR- 9/15- 60% OPPOSED- 4/15- 26% INDIFFERENT / WANT ADDITIONAL INFORMATION- 2/15- 14% 15 OF 40 TOTAL HOMEOWNERS RESPONDED- 38% At this time I am encouraged from those that see it as a benefit, however feel we would need to have at least 75% of all homeowners in favor prior to beginning a campaign fund raising program. Perhaps we can give this some more time (1-2 years) and readdress it after Sandy Lake Rd has been completed and our fellow neighbors have had a chance to discuss whether any capital improvements in the neighborhood are warranted at a later date.
