I have some changes on the proposed Service agreement. I don’t think Section 12 is applicable because we are a tax
exempt entity. I think Section 15.1 should only state that the Relocation costs are $40,000. The way it is currently
written allows them to adjust the $40,000 amount.

David,
We are working toward an agreement with Oncor Transmission (different from the distribution folks) for the removal of
their transmission lines along the south side of West Sandy Lake Road. We took a work session item to City Council last
winter, and they endorsed the idea, so we have been working on the agreement over the past several months.
The gist of the agreement is that we will fund the removal at a cost of $40,000, and we will grant them an easement
within the city right of way for their use in the future to erect a new transmission line when necessary. This is a good
deal for us in that we have conflicts with several of the poles, which would normally need to be moved at our expense,
and could likely cost more than complete removal.
I’m including the draft easement documents that Oncor has provided, with a few suggested changes that I have
made. I’m also including the agreement for the removal. I’d like to hear your thoughts on this. Can you look at these
documents, and give me a call when you get a chance?
