We will need to talk more about the logistics of relocating portions of our 24" water line to accommodate these poles. DO you envision covering that in the language of the agreement? See the attached PDF (attachment removed due to size). We have a few observations: 1. It appears a few of the pole locations may conflict with an existing 24" water line that belongs to the city. We will adjust the line to avoid these conflicts. If necessary, Oncor will reimburse the City for relocating the water line during construction of the line. 2. There may be conflicts with some existing franchise utilities in the alignment as well. Oncor intends to avoid the gas pipeline at the structure locations. The presence of the gas line under our line cannot be avoided. Oncor will reimburse other franchise utilities if relocation of their facilities is necessary. 3. It appears some of the poles fall outside the city owned right of way. In many of these cases they fall within a platted utility easement. Does Oncor have the right to install transmission towers within this easement, or are you asking the city to convey that right to you as part of this agreement? All structures should be within City controlled land. Our franchise agreement should allow the placement of structures within utility easements. 4. Assuming we agree on locations for these poles, and we execute all necessary agreements, how do we preserve these locations for your future use? Oncor does not expect the City to preserve the structure locations. If conflicts arise during construction, Oncor will reimburse as necessary. I have noted the conflicts with the existing utilities. The transmission lines are over the top of the 24” water line for approximately 1,800 feet from Cottonwood Drive to Oak Trail.
