Bryan,
Our City Manager, Clay Phillips will sign the agreement. The easement will need to be signed by Karen Hunt, the
Mayor.
th
Our next available City Council meeting is November 13. If I have the documents by the end of October, I can get us
on that agenda.
Thanks,
Keith

Bryan,
I think we can agree to both of these items. The hard cost allows us to get approval on the front end, and not have to
go back and ask for more when we’re done.
Once we receive new documents, I’ll schedule this on a City Council agenda and get it approved.
Thanks.

Keith,
Thanks for the reply.
With regard to the sales tax issue, we pay sales tax on all of our material through our warehouse. Because the
material is co-mingled with all projects (both reimbursable and not), our accountants cannot separate the tax from
the material issued. For this project, we only had $42.54 estimated in material tax. This will not make much
difference, but I cannot set a precedent to exclude without management approval.
I am agreeable to a firm cost for the project. However, if we agree to a firm cost, I would recommend a cost increase
to $45,000.00 to cover any contingency labor costs that may occur.
Thanks,

Bryan,
Attached is the easement document with a few requested changes. Our attorney also asked some questions about the
DSA. He believes we should be exempt from taxes due to our tax exempt status. He also requests that the language
under relocation costs be changed to reflect a firm cost rather than a variable cost depending on actual costs incurred.
Let me know your thoughts on these changes. Sorry to have taken so long.

Bryan & Matt,
I’m just following up on this Sandy Lake Road project. We are available to meet to go over the project, or review
documents and provide feedback.
We would like to see this resolved so it does not become a hold up for the project.
Thanks.

Bryan,
I’m putting together a project status update for our Mayor and City Manager, and I would like to include a tidbit about
this transmission line. Do you have a time frame on when we might see a draft agreement with easement
documents? Once an agreement is finalized what sort of time frame do you anticipate for removal of the line?
Thanks.

Keith,
We will initiate the survey. We can address relocation of facilities in the agreement. There should be satisfactory
clearance above underground utilities for safe working conditions.

Thanks Bryan. I see no reason why you could not proceed with the easement survey.
We will need to talk more about the logistics of relocating portions of our 24" water line to accommodate these
poles. DO you envision covering that in the language of the agreement? Is it safe to assume that there will be
adequate clearance under your wires for us to excavate and repair this water line if necessary?
Thanks,
Keith

Keith,
Thanks for reviewing our proposed alignment along Sandy Lake Road. See below in red for response to your questions.
With your approval, Oncor would like to survey the proposed route for preparation of the easement. We will adjust
the line to avoid the conflicts that you have referenced.
Please let us know if you concur and we will proceed accordingly.
Sincerely,

Subject: Fwd: Sandy Lake Rd - Transmission Poles
Matt/Bryan,
I took the transmission alignment that Matt sent me and had our consultant lay it out on our Sandy Lake Road
plans. See the attached PDF (attachment removed due to size). We have a few observations:
1. It appears a few of the pole locations may conflict with an existing 24" water line that belongs to the city. We will
adjust the line to avoid these conflicts. If necessary, Oncor will reimburse the City for relocating the water line during
construction of the line.
2. There may be conflicts with some existing franchise utilities in the alignment as well. Oncor intends to avoid the gas
pipeline at the structure locations. The presence of the gas line under our line cannot be avoided. Oncor will reimburse
other franchise utilities if relocation of their facilities is necessary.
3. It appears some of the poles fall outside the city owned right of way. In many of these cases they fall within a
platted utility easement. Does Oncor have the right to install transmission towers within this easement, or are you
asking the city to convey that right to you as part of this agreement? All structures should be within City controlled
land. Our franchise agreement should allow the placement of structures within utility easements.
4. Assuming we agree on locations for these poles, and we execute all necessary agreements, how do we preserve
these locations for your future use? Oncor does not expect the City to preserve the structure locations. If conflicts arise
during construction, Oncor will reimburse as necessary.
We look forward to discussing these issues, and any others needed to move forward with the removal of the existing
line.
Thanks,
Keith

Keith:
Attached are exhibits showing the Oncor Transmission Pole and overhead transmission lines alignment per the color
exhibit we received on 4/18. I have noted the conflicts with the existing utilities. The transmission lines are over the
6
top of the 24” water line for approximately 1,800 feet from Cottonwood Drive to Oak Trail. It is also over the top of the
existing gas lines east of Oak Trail. I have not reviewed any solutions to these conflicts as of yet.
