Attached is a slightly revised document. We need to preserve our right to respond to
emergency situations. We have a 24” diameter water line that parallels this proposed
easement, and we clearly cannot wait 30 days for Oncor to approve a request to repair a
catastrophic failure in this line. I have added language concerning “Emergency
Situations”. I didn’t include the definition, but I would expect the definition to be:
“Circumstances requiring immediate excavations, trenching, or other soil disturbing
activities by the City of Coppell in order to 1. Prevent imminent damage or injury to the
health or safety of any person or to the public right of way; 2. To restore service; or
3. To prevent the loss of service”
The City of Coppell is in favor of this agreement. We understand your need to protect
your assets, and your customers from the loss of service that could take place if we
were to cause damage to this proposed future transmission line. We have no desire to
cause any damage. Timely repairs of any failures associated with our utilities would
help ensure the stability of these towers.
