I drafted comments assuming the CLOMR will not be submitted to FEMA and that you do not wish to waive the requirement to show compliance with the ESA. If those assumptions are incorrect, I will revise the comment letter and send it to TNP. If you’re OK with the comments as written, I will send the attached to TNP. Just let me know. I’d like to draw your attention to three main issues with the study:  The proposed improvements result in increases in floodplain elevation in existing and ultimate conditions, and fairly significant increases in erosive velocity. This will require a redesign to address.  The Freeport Parkway bridge provides less than 1’ of freeboard in ultimate conditions. This will also require a redesign.  There is an existing residence downstream of the Sandy Lake Road bridge that this study places in the floodplain. I believe the address is 102 Winding Hollow Lane. It does not appear the effective FIRM panel shows the residence is located within the floodplain, so a LOMR based on this study may impose a mandatory flood insurance requirement for the homeowner. I recommend TNP 3 verify survey information for this area to determine if the residence is actually in the floodplain, and revise the mapping if necessary. It probably wouldn’t hurt to start this discussion with the homeowner, if you haven’t already. Depending on TNPs findings, there may be a need for a LOMR-F following this projects LOMR. From: Pickering, Brad Sent: Tuesday, June 11, 2013 2:32 PM To: Ken Griffin (KGRIFFIN@coppelltx.gov) Cc: Michael Garza (MGarza@coppelltx.gov) Subject: Sandy Lake Road / Freeport Parkway CLOMR Ken – Going through the TNP response to my comments on the Sandy Lake Road / Freeport Parkway CLOMR, I have a few questions.  The response indicates the CLOMR will not be forwarded to FEMA for review. Is that correct?  When do you anticipate a LOMR will be prepared?  TNP states the proposed project is anticipated to be compliant with the Endangered Species Act and asks that the requirement to obtain USFWS concurrence be waived. However, TNP provides no evidence to support their statement. Even if the project is not submitted as a CLOMR compliance needs to be demonstrated. The City, when signing a LOMR, acknowledges that compliance with the ESA has been achieved independently from FEMA’s process.
