On October 24, 1996, a Roadway Impact Fee assessed by the City of Coppell in the amount of
$9,139.20 for Zone 6 was paid by representatives of NAPA Automotive. Prior to and 'since that
time, representatives from NAPA have questioned that particular impact fee and requested that
the City review the ordinance to determine if it was correctly assessed. This is the first time
in which we have encountered a redevelopment of property i.e, one use was in place and that
use changed. Quite honestly, the impact fee was assessed in error.
I have reached this conclusion based on the following information:
1. In July, 1992, the previous owner paid $15,654.32 for roadway assessment for the
construction of Belt Line Road/Denton Tap Road. The original assessment on that
property was $13,056 with the balance being the interest due.
2. The definition of new development in our Roadway Impact Fee states new development
is based on an increase in service units. The original usage was a day care center and
this use is an automotive facility. Based on our Roadway Impact Fee, there has been no
increase in service units due to the change. If anything, the service units may have
decreased because of the high intensity of a.m and p.m. usage of a day care facility.
3. There was a change in our Roadway Impact Fee in January, 1996 which states that any
development that has received final plat approval prior to January 20, 1996 is only
assessed the lesser of the escrow for substandard roads or the roadway impact fee but in
no event will any monies previously paid be reimbursed to the user. The amount of the
escrow required for NAPA was zero since the road outside of the facility was already
constructed. The amount of the impact fee as previously calculated was $9,139.20.
Therefore, the assessment of the lesser would have been zero. The amount previously
paid was $15,654.32, however, as indicated there is never any situation where the City
would refund excess dollars of money previously paid.
Therefore, based on my more thorough analysis of the ordinance, it is my opinion and
recommendation that the City issue a refund check to NAPA Coppell Auto Supply in the amount
of $9,139.20.
