Like the several other tracts, this property includes a residential structure. TRANSPORTATION: Coppell Road is shown as a C2U, but is currently a two lane asphalt road contained within a 60'-wide right-of-way. The proposed 1996 Comprehensive Plan shows the property within a historic district. DISCUSSION: The "C" Commercial District permits the continuation of a residential use within an existing residential structure, but not the construction of a new residential structure. It permits the construction of a new commercial structure to house a business office. However, it allows the conversion of an existing residential structure to commercial use by special use permit only. The district also allows open storage by special use permit only. The use proposed for the existing residential structure at 522 South Coppell Road is that of a deck and fence contractor's office. The proposed use of the surrounding .65 acres is that of open storage. The site plan submitted with the application shows 3 parking spaces with concrete pavement appropriately landscaped to serve the 898-square-foot building. The open storage is confined to less a half acre located directly behind the proposed office use of the existing residential structure. It is partially screened by an 8'-high wooden fence. The screening does not meet the requirements of the zoning ordinance and, therefore, requires City Council action to modify the requirements of Section 33-1, 8. RECOMMI=-NDATION TO THE PLANNING AND ZONING COMMISSION: Staff recommends approval of the Special Use Permit subject to engineering recommendations and the following additional stipulations: 1) Restriction of materials delivery by tractor trailer truck to a route south of the facility and west of Grapevine Springs Park. 2) Removal of asphalt in the front yard and in the road right-of-way, except for the roadway pavement itself. Item # 8 3) Provision of access across the area of the Special Use Permit approved by the Fire Marshal for any structure requiring fire protection located on the remainder of the property. 4) Limitation of sawing and heavy equipment operations to the hours of 8 a.m. to 5 p.m., Monday through Friday. 5) No cutting of trees 3" in caliper or larger within 20' of the rear property lines of the lots facing Anderson Drive, nor within 30' of any other property line, with the exception of the cottonwood tree in the front yard. Dear John and Deann: Thank you for your letter of February 10, 1996, regarding your plans for the property you purchased in December 1995 and on which you are planning to operate your business, Dee's Deck & Fence, Inc. As you indicated, this property is adjacent to our lot, We appreciate your contacting us with regard to the trees, which are on your property but which back up to and overhang our yard. As we discussed earlier this week on the telephone, the City of Coppell has asked you to build a six-foot brick fence around the property you have purchased, which would necessitate the destruction of the trees. We do not want the trees behind our house destroyed. They not only provide shade to our home in the summer months, but also keep the water which stands on your property after rainfall from flooding our yard. In addition, we greatly enjoy watching and feeding the variety of birds who live in those trees, including a family of bluejays and a family of cardinals who have been there for the past three years, as well as an owl who has spent the last year with us. John, you told me that, unless the City forces you to build the fence, you have no intention of cutting down the trees. We will expect you to stand by those words. By copy of this letter, I am asking the City of Coppell to note our desire to save the trees and not require Dee's to build the fence. You and I also discussed the difficulties you had with some of your neighbors regarding the use of heavy machinery to clear your property last weekend. Because the weather was nice last weekend, I imagine many people had their windows open. I know we did. Frankly, the noise was irritating. One of the reasons we chose to move from Dallas to Coppell was the quiet we found here. I can well remember standing in the backyard of our house before we made an offer to buy it and commenting on how still and serene it was. That serenity is one thing we will fight very hard to keep. I am sure you can appreciate our position on that issue. John and Deann Wishaw Page 2 March 1, 1996 You told me in our conversation that you were only making improvements to the land by clearing brash and cleaning up trash. We feel certain that no one had a problem with your efforts to improve the lot, only with the time you chose to do it. You also told me you intended to work "seven days a week" at your new business. While I can appreciate your initiative and energy, we do not work seven days a week; and on the weekends we want to enjoy the peacefulness of our home. Thus, we would like some assurances from you, John, that you will not operate heavy machinery on the weekends, like you did last weekend. I do not really know how much fence and deck work relies on heavy machinery, but it is our hope that you can conveniently confine whatever machinery you do need to accomplish your work to operating on the weekdays only. Again, we wish to make the City of Coppell aware of our desires in this regard. It is our hope that your business does well in its new home. We are sure that if we all work together we can reach agreements which are mutually beneficial to everyone in the neighborhood. Please feel free to give us a call if you have any questions or if we can be of any assistance. Finally, we would ask that the City please inform us of any hearing, community meeting, study, investigation, etc., it may be conducting which concerns the property behind our lot so that we may participate.
