and p~vilege of passage in, ~ong, upon and across ~e following dcsc~bed prope~y owned by ~e
G~NTOR (the "E~emcm S~p") for the pu~ose of cons~cting ~d m~n~ning an undc~ound
s~i~ sewer and ~ainage system across G~OR's m~n ~act with ~e ~ght ~d p~vilege at ~1
times, of ~c G~ herein, i~s agents, employees, worsen and representativeness,
e~css, and re~ess in, along, upon and across said E~ement S~p for the

S~d Easement S~p being descdbed in Exhibits "A" and "B" attached hereto m o

That in consideration of the benefits above set out, G~EE will remove ~o ~~~,
such fences, buildings and other obs~ctions ~ may be found upon said properW. After cons~ction
of the under~ound sanit~ sewer and &~nage system has been completed or after any en~ for
repairs or maintenance, G~~E shall, except for removed obs~ctions, return the surface ~ea of
the easement s~p to its original condition as ne~ly as practical t~ing into consideration the nature
of the work being peffo~ed, including the repair or replacement of any existing buffed utilities %
streets and the replacement of any mobile home site improvement damaged or des~oye~.
G~NTEE shall provide G~OR with as much notice as may be reasonable under~
circumstances whenever work is to be peffo~ed and will use reasonable efforts to complete~t~
work in a timely fashion and with as minimal disruption as reasonably possible to G~OR ~..
G~OR's tenants. G~OR rese~es ~e fight to use and maintain the surface of the easem~h[
s~p for pu~oses which will not interfere wi~ G~EE's fights hereby ~anted and a~ee th~ ?~
upon completion of the under~ound facility and restoration of the surface, and, other than as se_
forth herein, G~EE shall not be obligated for hture maintenance and upkeep of the surface
