We were informed of an additional situation yesterday at 12:45p, which we responded to Kim Morris, Lewisville, with
meeting on site with her at 1:30p. When we met last week, with HOA, Coppell, Lewisville, Trinity Green, and RPM
personnel, we addressed the items we all thought were the culprit and met with Phil LaBerge, HOA, later in the week to
get approval to add additional measures. Per the pictures below we have taken initial steps to assist in controlling the
water we found coming from the west location at yesterday’s meeting and today we will add additional control
measures to minimize the impact to the Coppell HOA Subdivision to the south of the High Point Oaks Estates.
We are taking every event seriously and are making every effort to minimize any impact to any of the perimeter areas
outside this project. Please feel free to keep me informed as I have requested Rusty, Trinity Green, to do the same.
Rusty is having additional personnel to look at the site today to evaluate the site to see what additional measures can be
done to minimize the discharge of sediment. The necessary modifications will then be added and continue to be
monitored by the SWPPP personnel. I have also included the Lewisville Notice of Violation received yesterday.

I do understand and believe that you guys are doing what you can, but this is the third time this has happened in
about as many weeks. We have an enforcement response plan that dictates what actions we must take in
response to non-compliance. Non-compliance does not necessarily mean that something was done wrong, or
with negligence. Our records indicate that everyone involved has been cooperative, and has thus far taken
reasonable corrective actions in a reasonable time frame. But regardless, there have been multiple discharges
which have effected adjacent property. If a problem continues to occur, I am required to escalate enforcement
actions in response to that. As I said before, this enforcement action does not imply that there has been any
wrong doing. It simply establishes that the BMPs are not adequate, and that aggressive steps need to be taken to
reduce the offsite impacts. Taking into consideration the strength and frequency of the storms that we have
seen the past few weeks, and what those storms have done to the otherwise normally effective BMPs, extra care
needs to be taken. I have no doubt that the BMPs were chosen and designed to function effectively during
storms that we would normally expect to encounter at this time of year, in a region that has been in drought-like
conditions for a few years. But we are not seeing those same conditions, and you have to respond accordingly.

Dean and I just met your inspector onsite at 1:30. We did find some silt fence that been undercut by the water
on the construction site. We will repair and install J hooks so that hopefully doesn't happen again.
We will also install a few silt fence v-check dams along the other flow line of water coming from the site. In
addition, we are adding a line of wattles to the last v-check installed to assist in filtration.
We are doing everything we can with temporary BMPs to filter the water until the permanent solution is in
place. I will send out photos of the wattles and v-checks once installed.

My inspector was out at the site, and you are now flooding the Coppell property from the other side of the
drainage spillway. I believe it is the west side. The previous side appears to be functioning properly. I am
providing some photos. I would suggest that you contact Phil and get out ahead of this. If he hasn't already
been made aware of this, I'm sure he will soon be. It hasn't really rained that hard yet, so if it rains a lot more,
or we get a heavy downpour, it is probably going to be much worse. Do you know if that area has been
inspected recently? Kim said that it appeared that the water was going under the fence rather than over the
top. I don't think the vegetation should be relied on to be a filter BMP, because from the photos, it doesn't look
like it is doing much.

Thanks for the update. Like I said before, from what I have been told, it seems that everyone is doing as much
as they can do, as quickly as they can do it. I just want to make sure that HOA representative is kept in the loop
so that he understands this as well. I'm sure that his frustration is not only from this allegedly happening twice
recently, but also being uncertain as to what, if anything, was being done to rectify the situation. If he can be
reassured that this is going to be rectified, but that time is needed to complete it, then I think that will go a long
way to keep things from escalating out of control.

I spoke with Dean this morning, since there was absolutely no rain in the forecast, they were working to
excavate the area in question to install the retaining wall which should eliminate the issue we are having. Then,
very unexpectedly, the sky opened and dropped a torrential rain in a very short period of time, which is why we
had the discharge.
MI Homes was working to fix the problem at the best possible time, but mother nature was against them. Dean
has communicated this to the HOA, and is working to clean up the immediate mess and press on with the
retaining wall. Please pass this information along to the City of Coppell and even the TCEQ if necessary. I am
meeting with Dean this morning at the site to see if there is anything further that can be done to protect the area
during the install of the retaining wall. Thank you.

Below is an e-mail which I just sent to the Robby Mossier, the VP of M/I Homes who is
developing the property to our north (formerly Gehan Homes).

After the last storm event, we had water flood off their property and down our spillway into our
pond. Back in September of last year when I sent e-mails out to the Mayor and I met with you
to discuss the issue, this is exactly what I was trying to avoid, and yet it happened.
I will forward you their reply which basically says they are in compliance. When contacted,
Lewisville said water flowing onto our property in Coppell from theirs in Lewisville is not their
problem.
I am sure TCEQ will be contacting them. Is there anything you can do?

Hello Robby,
Back prior to you breaking ground we met with Robert Betancur with Zena Development and
the City of Coppell Engineering to discuss the water coming off your property and down our
spillway into our pond. We were, and continue to be, very concerned about mud an silt filling
up our pond. I had contacted the Mayor, City Council and others and was assured that we
would not have a problem. Back in 2010 when we had the pond dredged, it cost us $25k.
In the recent storm, rain water from you property gushed over your silt fence, down our
spillway and turned our pond brown with all the mud and silt in it. See the attached
photos. One of our neighbors saw it, took pictures and reported you to the TCEQ. I was
notified by him yesterday evening.
This occurred after I had e-mailed Dean back on the 17th (see below) about your silt fence
being buried in dirt and my previous e-mails regarding the subject.
Please let me know what action you are going to take to correct this and prevent it in the future.
