workmen and representatives having in.ess, e~ess, ~d re~ess in, flong, upon ~d across s~d
p~ses (~e "e~ement s~p") for ~e pu~ose of m~ng additions to, improvements on ~d rep~rs
to s~d ~nage system or ~y p~ thereof.

hereof for fll pu~oses.
~at in consideration of the benefits above set out, Gr~tee will remove from the e~ement
strip, such fences, buildings ~d other obstructions ~ may be found upon s~d prope~y. Mter
construction of the underground dr~nage system h~ been completed or after ~y en~ for rep~rs
or maintenance, GR~ shall, except for removed obstructions, return the surface ~ea of the
e~ement strip to its ofiginfl condition as ne~ly ~ practic~ t~ing into consideration the nature of
the work being peffo~ed. GR~TORS reserve the right to use and maint~n the surface of the
easement strip for pu~oses which will not interfere with GR~E'S rights hereby grated and
agree that upon completion of the underground facility and restoration of the surface, GR~EE
shill not be obligated for future maintenance and upkeep of the surface area.
TO HAVE AND HOLD unto the City of Coppell, Texas, its successors or assigns for the
purposes aforesaid, the premises above described.

BEING a tract of land out of the John F. Vest Survey, Abstract No. 1508, in the
City of Coppell, Dallas County, Texas and being part of a 36.339 acres tract of land
described in deed to HEATLEY-MOIST, INC. recorded in Volume 95021, Page
02386, Deed Records, Dallas County, Texas, (DRDC. T), and being more
particularly described, as follows;
COMMENCING at a "PK" nail with flasher found at southeast comer of said_
36.339 acre tract, and further being the southwest comer of a tract of land as ~
described in deed to ARC SPEII, L.L.C. as recorded in Volume 97084, Page ~ffl
of the DRDCT, and further being in the north line of a tract of land as described
deed to N.C.H. Corporation recorded in Volume 80022, Page 0311 DRDCT, s~-
