Box 478 Coppell, Texas 75019 Dear Howard: Dallas Water Utilities' engineers have almost completed the design of the new rate of flow controlled metering station at the revised location and are now in the process of satisfying the City of Coppell's floodplain requirements. Dallas Water Utilities cannot meet the May 1996 completion date for the new metering station because the extent of the work to meet the floodplain requirements is significantly greater than anticipated at the start of the design project. The final completion date for the construction of the metering station cannot be determined until all the necessary floodplain permits and requirements are resolved. At the beginning of the project, it was Dallas Water Utilities' understanding that Dallas would obtain a 404 permit from the Army Corps of Engineers if required and Coppell would obtain any other floodplain permits. Dallas pursued the 404 permit, and determined that a 404 permit was not required. Coppell then requested that Dallas obtain the other flood- plain permits. The floodplain permit requirements and scope of work changed during subsequent discussions and meetings between Dallas' and Coppell's engineers. Currently, a Corridor Development Certificate and additional land for valley storage are required for the floodplain permit. These two items have significantly expanded the scope of work from what is normally required for the design and construction of a rate of flow controlled metering station. The Corridor Development Certificate will require the use of an engineering consultant. Funding for the required engineering study must be provided by Coppell because this work is beyond the normal work required for the metering station design. Dallas Water Utilities is prepared to proceed with obtaining engineering proposals with your approval. This land will have to be obtained by Coppell when specific requirements are determined. Your assistance and approval are requested. Please confirm the floodplain requirements that Dallas Water Utilities must meet for construction of the new metering station. Please provide approval for the funding of the additional engineering work required for the Corridor Development Certificate, and please provide assurance that Coppel] will obtain the additional property required for valley storage.
