of Coppell the interpretative authority without jeopardizing the
Flood Insurance Program.

Based om the preceding info,nation and in order for PCJV and the Purchaser
to be correctly informed of the City's requirements for those still
unreclaimed portions of the PCJVpropert¥, we request that you, as City
Engineer and as City Floodplain Administrator, confirm that the City
recognizes that the issuance of the Preliminary Approval Letter, as later
confirmed by FEMA's issuance of final ~p revisions on February 15, ]984,
established the base flood elevations and required floodway encroachn~nt
limits for the PCJV property; and that these existing ~.~4A approvals
exempt the PCJV property from the provisions of the Ordinance pursuant to
Section A'of Article 3 of the Ordinance so lonq as the reclamation work is
performed., in compliance with the Preliminary Approval Letter. It is
understood, however, that (1) proposed work which materially deviates from-
the Preliminary Approval Letter Js not exempted from the Ordinance, and
(2) any proposed work must comply with all requirements present or future

to a letter dated June 28, 1982 from Mr. James R. Eltum, III, former City
Administrator, regarding flood boundary adjustments in the coamunity, we have
evaluated the technical data and completed modifications to the Flood In-
surance Rate Map (FIRM), Flood Boundary and Floodway Map (FBFM),.and Flood
Insurance Study (FIS). We are sending you two (2) copies of the preliminary,
modified FIRM, FBFM, and FIS for.your community. We request that you review
the proposed modifications.
If you have any coneents on the proposed modifications that might justify
modifying our results, please use one (1) copy of the enclosed maps to
identify the area of concern and return it to us within twenty-one (21) calendar
days from the date of this letter. If you should find no conflict with the
maps, please return one copy of each map with a letter stating you have reviewed
the accompanying material.

Thio is in reference to a letter dated December 10, 1986, and technical data
eubuitted by Ha. Shohre llaneshmand, C~ty Civil Engineer for the City of
CoppelX, regarding the Flood Insurance Study (FIS) for your community. Xn her
letter, Plo. Daneshmand requested that the PederaX m-ergency Management Agency
(FFJ~A) Issue a Letter of Map Amendment (LCWqA) to Incorporate completed channeX
and floodplain modifications along Denton Creek. The area of concern for this
request extenda from Denton Tap Road to De Format Road. All necessary materials
to process thio request Were received as of June 29, 1987.
It should be noted that m LCXqA Is issued only to remove the Special Flood
Hazard Area (SFHA) designation, aborn on the effective Flood Insurance Hate
Map (FIRH), from an area occupied by a particular structure If it Is Above the
existing Base (lO0-year) Flood Elevation (BFE). Because this rIKluest Il baaed
on a completed channeX modification, v~ich results In a reduction tn the BFEo
and the 100- and 500-year floodplain delineations along a portion of Denton
Creek, a Letter of Map Revision (LG~R) to the PXS, PXRM, and PXood Boundary
and Floodway Map (PB~Iq) Is being issued in lieu of a LC~A. A L(~4R ia needed
to revise the BYEs and 100- and 500-year floodplain delineations along Denton
Creek based on changes In the hydraulic parameters used tn the effective PXS,
FIRM, and PBFM for your community.
Me have reviewed the submitted data that were prepared by Threedgtll-Dovde¥ &
Associates, vhlch IncXuded the follovtngs H~C-2 hydraulic modeXing of pre-
end pomt-channel modification conditi~ha, dated June 29, 19871 end topographic
mapping, dated September 12, 1986, representing the proposed changes to the
FXS, PXPJd, end PBFH. Based on these data the BPE8 end 100-year floodway
elevations, and the 100-year (Zone A3) and S00-year (Zone B) floodplains along
Denton Creek have been revised for a distance of approximately !.6 miles
downstream of Denton Tap Road. This L~Pm amends PZR~ and rBFHnumber 400170,
panel 000S and the PiS text, all of vhtch aye dated February 15, 1984. These
changes are ihovn on the enclosed flood, profile sheeta~ annotated rXS text
Table 2, entitled 'Floodway Date'S annotated Portion of FIRM penal 0005 Cs
and annotated portion of FBFM panel 00~5. Please note that the locations
of the Denton Creek crams sections B and J have been reviend, am ehoun on
the enclosures.
AndMrson Engineers, Inc., is currently restudying several atres-s within the
City of Coppell, including Denton Creeki the analyses for the restudied
strea~s abe to be subsisted to FFJiA ~y your co~munity for our review. The
analyses will then be used as the basis for a revision to Coppell's FIS, FIRM,
arid FBFN. This LO~R will be superseded by the revised PIS, FIRM, and FBFN
based on the Anderson Engineers analyses.
Public notification of .this LOHR will be given In The Citizens Advocate on or
about October 9, 1987, and October 16, 1987. A copy of this notification Is
enclosed. In addition, notice of changes*will be published In the Federal
Register,. He encourage you to supplement this notification by preparing an
article for publication in the community newspaper. This article should
describe the changes that have been made and what assistance the ccxumunity can
give in providing data and Interpreting the maps.
It should be noted that National Flood Insurance Pro, ram regulation 44 CFR
60.3(b)(7) requires communities to 'assure that the flood carrying capacity
within the altered or relocated portion of any watercourse is maintained.'
This provision is incorporated Into your community's existing floodplain
management rngulations; consequently, responsibility for maintenance of the
modified channel rests with your community.
The revised BFEs are effective as of the date of this letter; however, within
90 days of the ascend publication In The Citizens Advocate, a citizen may
request that FENA reconsider the deter~iflation made by this LCliR. Any request
for reconsideration must be based on scientific or technical data. AIl
interested parties are on notice that until the 90-day period elapses, FENA~s
determination to ~odify the BFEs presented in this LCI~R may Itself be modified.
Since t~.~8 LOMR will not be printed and distributed to users such aa insurance
agents and lenders, the community will serve as a repository for the new data.

· he determination made in this LC~ta has been made pursuant to Section.206 of
the Flood Disaster Protection Act of 1973 (P.L. 93-234) and is in accordance
with the National Flood Insurance Act of 1968, as amended (Title Xlll of the
Housing and Urban Development Act of 1968, P.L. 90-448), 42 U.S.C. 4001-4128,
and 44 CFR Part 65. Aa required by this legislation, I community must adopt
and enforce floodplain management regulations in order to ensure continued
eligibility to participate in the National Flood Insurance Program. Therefore,
the City of Coppell must enforce these ~equlatlons using, at a minimum, the
elevations and zone designations in the SFIL&o as sho~n on your community's
FIRM, including the modifications made by this LGftR.
The map aa listed above and as amended by this letter will be used for all
flood insurance policies and renewals issued for your community.

This letter is written to you in your official capacity as City Engineer
and Floodplain Administrator for tile City of Coppell, and documents a
meeting in our office on April 27, 1988, to discuss specifically the portion
of Cottonwood Creek upstream of Denton Tap Road, known also as Parks of
Coppell Joint Venture II. lhose in attendance were Maryetta Cunningham
and Bill Kuno of this office, Mr. Dan Dowdy and yourself.
The purpose of the meeting was to discuss that provision of the City's
Floodplain Ordinance which allows exception to the n~re stringent design
criteria in cases where a "prior conditional approval from FEI4& has been
obtained prior to enactment of the ordinance."
As explained in our previous letters dated March 30 and April 11, 1988,
a thorough search of -files in our office and by the engineering staff
in Washington did not identify that a proposed floodplain modification
for that portion of Cottonwood Creek had been submitted to FEMA or that
any Conditional approval for a proposed project had been issued by FEMA.
Iluwever, our research did document and verify that a submittal was made
on June 28, 1982, by Carter & Burqess of more refined technical data which
showed tile FEMA study and maps ~o be in error for that portion of Cottonwood
Creek with which Mr. Dowdy is concerned. That submittal resulted in our
evaluation and approval of the submitted technical data and our issuance
of a preliminary and final map revision to incorporate the Carter & Burgess
data.
It is the role of tile City of Coppell Lo evaluate any request for exception
from tile more stringent design criteria of its ordinance under the basis
established for such exception; i.e., "tile obtaining of a conditional
approval from FEHA" prior to enactment of tile ordinance. If tile City
of Coppell determines that the subject submittal of technical data and
resultant issuance by FEHA of a preliminary/final map revision for that
