Dear Mr. Ginn:
This letter is being written to you in your role as Floodplain Administrator
for the City of Coppell, Texas.
By Letter of Transmittal you have requested that we determine whether a
Conditional Letter of Map Revision has been issued by FEMA for a portion of
Parks of Coppeli Joint Venture II, located west of Denton Tap Road within
Cottonwood Branch floodplain. I have reviewed the correspondence attached to
your Letter of Tran§mittal and researched our Coppell Community files. These
document that:
1) No request for a Conditional Letter of Map Revision for the subject
portion of the Parks of Coppeil has been received by FEMA nor any Conditional
Letter of Map Revision issued based upon proposed 'floodplain modifications
of this portion of Cottonwood Branch.
2) The letter dated November 8, 1982 from Michael Baker, dr., Inc. (FEMA
cont.ract engineering firm) submitted to the City of Coppel] copies of a Pre-
liminary Revised F}ood Insurance Study based upon our app~Ova] of more accurate
technical data obtained by Carter-Burgess, Inc., through use of 2 ft contour
mapping and additional surveyed floodp]ain cross sections. This was for a 2.6
mile stream segment from DeForest Road to approximately 1/2 mile upstream of
Denton Tap Road. The revised preliminary base flood elevations were published
in the Coppell Star on May 5 and 12, 1983, and were issued in a final, revised
Flood Insurance Study with Flood Insurance Rate Maps and Floodway Maps dated
February 15, 1984.
The subject r~vision was not related to any FEMA conditional approval of a pro-
posed floodplain or floodway modification by Parks of Coppeli Joint Venture II.
FEMA is restricted by regulation to revising currently effective maps only on
the basis of FEMA approved "As-Built" conditions. Should you desire further
assistance in this matter, please let me know.

Floodplain Reclamation - Parks of Coppell
Dear Wayne
The Parks of Coppell Joint Venture II ("PCJV"), the owner of the Parks of
Coppell property, is currently negotiating a contract of sale on a portion
of its land. The potential purchaser ("Purchaser") has requested certain
assurances regarding the City's interpretation of its recently adopted
Flood Plain Management Ordinance (the "Ordinance") as it relates to the
modifications of the Flood~y Boundary and Flood~y Map (the "Floodvay
Map") which were preliminarily approved by the Federal Emergency
Management AGency ("~") by letter to the City frcrn Michael Baker, Jr.,
Inc., consultant to FEMA, on November 8, 1982, together with attachments
thereto, (the "Preliminary Approval fetter") copies of which have been
supplied to your office. A copy of the cover transmittal letter of the
Preliminary Approval fetter is attached hereto.
As we have explained to you, the Preliminary Approval Letter was issued by
FEIMA on the entire Parks of Coppell project, both east and west of Denton
Tap Road. Based upon the Preliminary Approval Letter, the majority of the
flood fringe land in the Parks of Coppell which lies east of Denton Tap
has been filled and reclaimed over the last 4 1/2 years in c~mpliance with
the Preliminary Approval Letter and, on September 24, 1987, FEMA issued
its Letter of Map Amendment removing the reclaimed areas from the flood
plain (cover letter enclosed), thus recognizing the c~mpletion of work
contemplated by the Preliminary Approval Letter. As to those Darts of
PCJV land which have not yet been reclaimed which lie west of Denton Tap,
the f]ood~y boundaries approved in the Preliminary Approval Letter and
accompanying Flood~y Map are identical to the floodway boundaries shown
on the later February, 1984 FEMA map and the current September, 1987 FEMA
map.

Based on the preceding information and in order for PCJV and the Purchaser
to be correctly informed of the City's requirements for those still
unreclaimed portions of the PCJV property, w~ request that you, as City
Ebgineer and as City Floodplain Administrator, confirm the following:
1. The City has and still does recognize the Preliminary
Approval Letter as ~onditional approval from Ff~A as of the
date of its issuance. Based on this conditional approval fr(zn
FfMA, the City has and will continue to approve reclamation
work on PCJV land which is perfonned in material c~mpliance
with the Preliminary Approval lJstter.
2. The City recognizes that the issuance of the Preliminary
Approval Letter exempts the BCJV property fr~m the provisions
of the Ordinance pursuant to Section A of Article 3 of the
Ordinance so long as the reclamation work is performed in
compl lance wi th the Preliminary Ap~roval Letter. It is
understood, ho%ever, that proposed work which materially
deviates from the Preliminary Approval Letter is not exempted
from the Ordinance.
If .you are in ag~reement with the contents of this letter, please confirm
the City's agreement by executing this letter in the space provided below.
