I did forward this email to Ken Harter...
He is out of town this week...
I have requested under the Freedom of Information act,
information from the coppell city secretary,
Respectfully, I have discussed this issue with you and was told with "complete" settlement,
that the easement dedication of frontage taking of Oak trail property was proper by city engineeering
and bond project.
The "taking" of sandy lake easement, capitalized by the bond project, would have been handled by attorney
Ken Harter, but I trusted
you to keep your word to me regarding fencing, sprinkler system and trespass....
and what did I receive, lowest payout, fencing not approved and sprinkler system still in chaos, as well as
flooding plans not of interest for Oak Trail...
and telling me you would be replacing drive way, two car, cement drive when your true intentions was to
"widen" oak Trail with my property and tear up my drive....

Now I know that it is impossible for any words to mean much to you, not your property, a job......., all that is
cared about is how you perfom, and keeping one's word is only as good as what is in writing...a lesson which
has cost me...
Thank you for your reply, I will await city secretary reponse and follow-up with Ken on his return to DFW.

I have forwarded all of the correspondence concerning the Sandy Lake Road project from 2004 to present to the City
Attorney for review. I just spoke with him, and he has left a message for Mr. Harter to contact him at his
convenience. As long as Mr. Harter represents you in this matter, our attorney, David Dodd, will need to speak with him
prior to making contact with you.
I would like to reiterate my offer to for the four of us to sit down and discuss your concerns and claims against the
city. We would be happy to meet at the city offices at a time that is convenient for you and Mr. Harter.

I attached DEEDS which are being filed.
Last night, I spent two hours with a real estate litigating attorney regarding
the past issues of oak trail. Ken is a real estate litigation attorney...who writes business contracts.

I know, the city does not get it, and will say anything to appease what they want regarding trespass
and flooding,
Oak trail issues of road runoff, years of rivers of water washing away top soil basically ignored, said not your
problem, some other department, Moss turret and drainage from this property, drainage plan for back of
property which does not work (I referred Moss to this attorney successfully for litigation on another real
estate issue) sandy lake easement purchase value compared to
beas and mills, and now the taking of Oak Trail property with utility easement
presented. Mr Moss can tell you the flooding in his back yard sometimes comes up to his back sliding
door...mine penetrated the house, so I replaced door with French door and replaced carpeting, without
insurance.

The city "taking" the oak trail easement for utilities and my concrete drive set back as a part of the road is the
line drawn in the sand.
Ken suggested that the Coppell city attorney offer the final opinion, IN WRITING....regarding the taking of drive
and land using the easement grant, when precedence for sandy lake easement taking of land was paid for. He
is awaiting the city attorney opinion to my attention.
Meanwhile, I intend to alert my neighbors in shady dale that this easement needs recinding...NOW.
Remember, Keith, you did not bring the easement document on sandy lake taking for widening the road,
remind the city attorney, that the city paid for the easement widening...and the city is TAKING my front
property easement for WIDENING OAK TRAIL INGRESS AND EGRESS, AS WELL AS MY DRIVE WAY...shortening
my approach. that is the opinion I need in writing, before proceeding, that the city attorney agrees with
you...and if he does, then nothing left but to file...and I promise you, I will, but not before I ask the neighbors if
they agree.
