Ms. Lein:
This offer is rejected. You have the terms that Mr. Ware gave you or if not I will be more than happy to repeat them for
you.
Whether you know or not, there has been a retarded song and dance going on around this issue for over a year and a
half. You just showed up to the party late and didn't see what has already happened in the form of discussions. Unless
you were in the background and are playing dumb, then no one has ever told you this from either the city or a coworker of
yours that was previously discussing this same issue using a different term.
Whether you call it a "tree trimming agreement" or aerial easement, they both facilitate the same thing. Either one will give
Oncor the ability to cut trees as they see fit using someone who they have deemed good enough. I own other properties
where similar agreements were in place and your company BUTCHERED the trees to look like shit. I have pictures of
what your company did along Denton tap less than 3 months ago that looked like a Kinder Gardner was given a chainsaw.
You should understand that your company's work ethic reflected in your contractors holds no water in this situation at all.
Your personal guarantee as an employee or representing Oncor simply means another person who can't fix a problem
after it has happened.
1
Your appraisal conducted doesn't account for the trees value to the property, does it?. The wood value itself isn't what the
concern is over. It is about the over all impact of the lot's value without the trees that could POTENTIALLY be cut down by
Oncor's whim. The simple fact is that if your company cut down every tree within 10 feet, then it has impacted the property
value beyond the actual value of the trees alone and they cannot be replaced. You can't replace a 30 year old tree
so once these are gone they are gone.
So when your company is ready to pay $30,000.00 for this "tree trimming agreement", then change the $1,700.00 amount
on your letter.
Otherwise, we have nothing further to discuss.
CRYSTAL
Is this clear? A simple yes or no response will do.
I'm not being an ass by asking you the above question. There has been enough time wasted on this issue and either you
aren't getting it or you are ignoring it and don't care to answer. You can mean yourself or Oncor.
