Re: Sanitary Sewer Easement

Dear Ms. Bowman:
As we have previously discussed, the City of Coppell presently occupies
land outside of its recorded easement, with a sewer line across property
presently being platted as the Creek View Addition.
In order to facilitate the sewer line in its "as-is' location, we have
written a sanitary sewer easement description on the Creek View Property, that
would be granted as a new easement for the existing sewer line.
Concurrent with granting of a new easement, the old or existing easement
that the City holds must be abandoned, and a description of the abandonment
has been drafted as well.
The new filing and the abandonment should be handled simultaneously, and
we would request that your office prepare an instrument for filing and
abandonment that would be executed by both Mr. Thompson and the City of
Coppell.

Proposed 20 Foot Sanitary Sewer Easement Abandonment
Being a tract of land out of the McKinney and Williams Survey, Abstract No.
1054, in the City of Coppell, Dallas County, Texas, said tract being part of a
tract of land as recorded in Volume 76103, Page 0442, of the Deed Records,
Dallas County, Texas (D.R.D.C.T.), and being more particularly described as
follows;
COMMENCING, at a 5/8-inch iron rod found at the intersection of the northerly
right-of-way of the St. Louis and Southwestern Railroad (a 100 foot R.O.W.),
as recorded in Volume 95, Page 529, of the D.R.D.G.T.; and the east right-of-
way line of Denton Tap Road (a 100 foot wide R.O.W. at this point); Thence, N
O0° 55' 33" E, along said east right-of-way line, a distance of 585.42 feet to
a found 1/2-inch iron rod, said rod being the northwest corner of a tract of
land leased to Joe Bob Fikes, as recorded in Volume 83035, Page 1156, of the
D.R.D.C.T.; Thence, N 86° 01' 03" E, departing said east right-of-way line,
and along the north line of said Fikes tract, a distance of 294.04 feet to the
centerline of a creek; Then_c_e, S 47° 44' 03" E, along the centerline of a
creek, a distance of 39.98 ~eet to the POINT OF BEGINNING; --
