Re: Additions to the Village Parkway Pump Station
Electronic Drawing Files
Dear Mr. Griffin:
As you requested, we are delivering the electronic drawing file of Sheet No. C6 of the Additions to the Village
Parkway Pump Station project. The electronic drawing file is in Acad R12 format. Since the construction of
the project is not yet completed, the electronic drawing file has not been revised to conform to construction
records.
We are delivering the electronic files to the City under the following conditions:
1. The files are compatible with Autocad R12 by Autodesk. We do not make any warranty as to the
compatibility of these files beyond the release of Autocad R12.
2. Because data stored on electronic media can deteriorate undetected or be modified, it is agreed that
Shimek, Jacobs and Finklea will not be held liable for completeness or correctness of electronic media
after an acceptance period of thirty days after delivery of these files.
3. The electronic files are an instrument of Shimek, Jacobs and Finklea's service. Where a conflict exist
between the hard copy drawings and the electronic files, the hard copy drawings will govern in all cases.
4. Both parties acknowledge mutual non-exclusive ownership of the electronic files and each party may use,
alter, modify or delete the files without consequence to the other party.
5. The electronic files provided to the City, do not contain engineers seals, handwritten dates, nor signatures.
