Comments included on the permit by the building inspector informed the contractor that the wall could not be built within the sanitary sewer easement. The retaining wall is an extension of an existing wall installed by the neighboring lot owner to the west (Lot I0, Block B). Upon reviewing and discussing this matter with Steven Goram, Staff has no objection to the retaining wall encroaching the easement. However, it will be necessary for the City's Attorney to draft a hold harmless statement, to be signed by the homeowners, indemnifying the City from any damage that may occur to the wall if repair of the sewer line was necessary. I have contacted Larry Jackson and asked him to prepare the hold harmless statement. If you have any questions regarding this matter, please advise. HLP /mp Alan D. Ratliff, City Manager Steven G.
