Metroplex Retaining Walls was issued a permit to build a retaining wall at Z52 Bethel Road. Comments
included on the permit by the building inspector informed the contractor that the wall could not be built
within the sanitary sewer easement. The contractor did not notice the comments and did locate a portion
of the wall within the sanitary sewer easement.
Staff has reviewed the effect of the wall being located in the sanitary sewer easement and has no
objection to allowing the wall to remain as is provided that the attached "Hold Harmless Agreement~'
is signed.

As you are aware, a retaining wall has been constructed on the
above referenced property which encroaches a sanitary sewer
easement located on the west side of the lot. The retaining wall
is an extension of an existing wall installed by the neighboring
lot owner to the west (Lot I0, Block B). Upon reviewing and
discussing this matter with Steven Goram, Staff has no objection
to the retaining wall encroaching the easement. However, it will
be necessary for the City's Attorney to draft a hold harmless
statement, to be signed by the homeowners, indemnifying the City
from any damage that may occur to the wall if repair of the sewer
line was necessary.
I have contacted Larry Jackson and asked him to prepare the
hold harmless statement.

HOLD HARM~m~S AGREEMENT
WHEREAS, the owners of Lot ll Block B ,
o,~..~ Coppell, Texas (the owners), understand and
acknowledge that the retaining wall which is located on their
property encroaches onto the City of Coppe11's sanitary sewer
easement; and
WHEREAS, owners understand and acknowledge that in case
repairs or improvements are required to be made to the City of
Coppell's sewer system which would require removal of the wall in
order to effect such improvements; and
WHEREAS, owners recognize and acknowledge that such retaining
wall was installed despite knowledge of the City's sanitary sewer
easement;
Owners hereby agree to remove such retaining wall at their own
cost and upon request by the City of Coppell, and if owners fail to
remove the wall upon request by the City, then City will remove
such retaining wall and owners hereby indemnify and hold the City
harmless from all claims of damage to the wall which arise from the
City's removal of such wall while repairing, inspecting, improving
or in any way seeking access to the sanitary sewer system.
Additionally, owners agree to reimburse the City for the reasonable
costs incurred in removing the wall.
