Re: Cree~iew Eas~ent (~en~ent) ' ~ ;' ~ ~ ~
mrsuant to your re~st for review a~ a~proval ~~e
referenced project, we offer the following.
We talked to the engineer, Mr. Wallace, from Na~an Ma~er and he
indicated ~ey made a ~C-2 analysis and ~ assure ~e City
that ~e 15' easement would provide the need~ protection for
houses, and meet the drainage retirements. He indicated that
the difference between the p~posed 15' eas~ent and the existing
30' easement would be negligible wi~ regards to flowing. In
his letter he gave reasons for the reduced wid~ easement.
It was our un6erstanding, as far back as the conceptual stage,
that the areas now sho~ to ~ drainage eas~ents were ident~fi~
as. also being "~een ~~ Variances to have ~ese green
spaces in lieu of alleys was allowe6. It was also to be utilized
by various utilitieS, GTE, an6 cable, for example. ~e City
Council and P & Z approved the plans with those things in mi~.
We did not receive enough info~ation regar6ing the valiaity of
Mr. Wallace's statements pe~aining to the flowing. Therefore,
we cannot cogent from that ~int of view.
We respectfully suggest that based upon what has been an
acceptable 6rainage easement (30' wide) fro~ ~e ve~ ~i~ing
and based on previous e~eriences wi~ similar eas~ents in other
~arts of the City, we would s~rongly urge you to keep the 30'
easement as sho~ and not reduce it to 15' as re~ested.
Please contact us should you have any ~estions.
Sincerely,
Gabe Favre
