Dear Russell,
Thank you for your efforts noted in the referenced (A) letter.
Since our last meeting April 4th, we have experienced the first
severe flooding along Grapevine Creek in the eleven years I have
lived here. As a result of the heavy rains, the creek overflow
at the sanitary sewer crossing has again caused accelerated
erosion in the immediate area downstream of the cast iron sewer
line. Note: the line is located on the south/downstream edge
of the easement where the creek bank is NOT protected from the
accelerated velocity of the water. This increased volocity is
the direct result of the placement of the round concrete support
column/pier. Selection of the crossing site and placement of the
supporting structure(s) is the SOLE RESPONSIBILITY of Nathan
Maier Inc. This sewer line services part of the Creekview dev-
elopment and other commercial property along Beltline Road belong-
ing to Mr. Bill Thompson. Therefore, Mr. Maier's statement (ref.B)
that "off site treatment along the creek bank...is not a part of
the subdivision plans" - is NOT valid. Mr. Maier continues to
ignore this fact and is attempting to avoid acknowledging resp-
onsibility for his design of the sanitary sewer crossing. I have
documented evidence proving that the placement and configuration
of the sewer line support column's has, and continues to cause,
vastly accelerated erosion to the creek bank. In essence the
"Natural Stream Dynamics" has been dramatically altered by construc-
tion designed and built by Mr. Maier. Therefore, it is imperative
that Mr. Maier be held responsible for his design and the conse-
quences thereof. The excessive erosion to the creek bank both
within the easement and to either side must be corrected immediate-
ly; and adequate measures implemented to prevent further damage to
the creek wall, i.e. raise and lengthen the concrete sack structure.
In my opinion, this situation should be corrected by Mr. Maier-
not the City of Coppell. However, if the city manager or the
council prefers to fund the necessary corrective measures, I
have no objection. Please be assured that I will continue to
monitor this situatiion to assure that an equitable solution
is attained. I will be happy to continue to assist you in any
way I can.

The debris has been removed in and around the aerial sanitary sewer
crossing at the creek behind Mr. Johnson's residence.
Russell Doyle and I have scheduled a meeting to meet with Mr. Johnson
at 5:00 p.m. this date and I will follow up to you concerning the
meeting on Monday, June 5, 1989.
