Attached is a copy of the design engineers response to Mr.
Steve Morton, Chief Public Works Inspections, April 6, 1989
letter (copy attached).
As we discussed with Steve Goram, Director of Public Works
on Tuesday, April 4, 1989, there appears to be some erosion
around the erosion control structure and we indicated we would
get the design engineer for the developes to look into it and
Mr. Maier has responded by the attached letter.
While I cannot respond to the agreements between yourself and
Mr. Maier and how that relates to the subdivision plans and
maintenance bond, I am available for any additional reviews

Being in receipt of a letter of April 6, 1989, from Mr. Steven Morton, we have reviewed the erosion
control placed along the Grapevine Creek bank in the city's easement. We find that the control is
working exactly as expected and protecting the slope of the easement.
As you are aware, we have always maintained that our preference was to keep the banks of the stream
in their natural condition. While this means vertical bank walls and some continual erosion, those are
simply natural stream dynamics.
The expensive and substantial off-site treatment along the creek bank was installed solely at the request
of the neighboring owner, and not as a part of the subdivision plans.
The stream's dynamic nature has always, and will always continue to alter the natural slopes of the
creek. To attribute any specific slope erosion or slope failure of a vertical slope on the outside bend of a
stream bank after a series of particularly heavy rains to other than stream dynamics would be difficult.
The installed protection worked particularly well during that same heavy flow period.

Mr. Johnson has contacted Russell Doyle and Steve Goram in reference to the
erosion of his bank. He feels that the erosion control that was installed is
causing this bank down stream to be eroded and that the base of the structure
is also washing away.
This subdivision is still under warranty. It should be in your best interest
to become involved and visit the site to evaluate the conditions and take
corrective measures on your evaluation.
