Dear Mr. Doyle:
Pursuant to your request, the following letter provides additional information concerning the requested
easement amendment for the Creek View Addition. My letter of August 8, 1989, originally addressed
our request to amend this easement. In my follow-up letter of October 20, 1989, we provided additional
data concerning the peak discharges from the proposed property and a HEC-2 model displaying the
corresponding results.
The original easement was sized to be 30 feet, since the actual lot grading plan was not completely
known, and there was a potential for additional off-site drainage. Since that point in time, the individual
lot grading has been established, and it has been further verified that no off-site drainage will be con-
veyed to this drainage easement. These revisions and verifications have resulted in a re-evaluation,
which has allowed the easement to be reduced as proposed. This reduction will also provide more
usable area for private properties which back up to this easement.

AN ORDINANCE OF THE CITY OF COPPELL, TEXAS
ORDINANCE NO.
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, ABANDONING AN
UNNECESSARY DRAINAGE EASEMENT; PROVIDING THAT SUCH ABANDONMENT SHALL
BE THE INTEREST WHICH TIlE CITY MAY LEGALLY AND LAWFULLY ABANDON;
PROVIDING TIIAT SAID ORDINANCE SHALL CONSTITUTE A QUITCLAIM DEED THAT
MAY BE RECORDED WITH THE COUNTY CLERK OF DALLAS COUNTY, TEXAS; AND
FOR PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Coppell finds that the following
drainage easement is no longer needed for public purposes; and
WIIEREAS, the abutting property owners desire that said drainage easement be
abandoned and in consideration thereof has dedicated to the City of Coppell, Texas,
an additional drainage easement which is needed by the city for public purposes; and
WtIEREAS, the City Council of the City of Coppell finds that said property is
a narrow easement and should be exchanged for such other easement to be ded|eated
by the abutting property owners, William Thompson, Roy Brock, Louis Crump, Frank
Bamburg, Ricl~ Oates, and Dr. and Mrs. Pat Evans. NOW, THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS:
SECTION 1. The hereinafter described drainage easement is no longer needed
or necessary for public purposes and should be, and is hereby, abandoned in favor the
property owners abutting the portion of easement being abandoned. The drainage
easement hereby abandoned is described in two tracts as follows:

ABANDONMENT OF EXISTING 30 FOOT DRAINAGE EASEMENT
Being a 0.30 acre tract of land situated in the McK]nney and Williams Survey, Abstract No. 1054, City of
Coppell, Dallas County, Texas, and being a 30 foot width drainage easement as dedicated by final plat
of '"Creek View Addition," as recorded in Volume 88116, Page 3069, of the Deed Records of Dallas
County, Texas (DRDCT), and being more particularly described as follows;
BEGINNING at a point on the south right-of-way line of Bethel Road (50' R.O.W.), sald point being
128.61 feet east of Glendale Drive (50' R.O.W.), and the common corner of Lot 37 and Lot 38, Block "B",
of "Creek View Addition," as recorded in Volume 68116, Page 3069, DRDCT;

SECTION 2. This abandonment ordinance shall constitute a Quitclaim Deed in
favor of the owner of the property abutting the easement being abondoned and a
certified copy of the same may be filed in the Deed Records of Dallas County, Texas,
to indicate such abandonment.
SECTION 3. The abandonment provided for herein shall extend only to the public
right, title and interest which the City of CoppeI1, Texas, may have in and to said
drainage easaement, and shall be construed to extend only to such interest that the
governing body of the City of Coppell, Texas, may legally and lawfully 'abandon.
SECTION 4. This ordinance shall take effect immediately from and after its
passage and approval by the Mayor of the City of Coppell, attested by the City
Secretary, as the law in such cases provides.
