Box 478 Coppell, Texas 75019 Re: Creek View Addition NDM No.: 87-5-62 Dear Mr. Doyle: Pursuant to your request, the following letter provides additional information concerning the requested easement amendment for the Creek View Addition. My letter of August 8, 1989, originally addressed our request to amend this easement. In my follow-up letter of October 20, 1989, we provided additional data concerning the peak discharges from the proposed property and a HEC-2 model displaying the corresponding results. The original easement was sized to be 30 feet, since the actual lot grading plan was not completely known, and there was a potential for additional off-site drainage. Since that point in time, the individual lot grading has been established, and it has been further verified that no off-site drainage will be con- veyed to this drainage easement. These revisions and verifications have resulted in a re-evaluation, which has allowed the easement to be reduced as proposed. AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, ABANDONING AN UNNECESSARY DRAINAGE EASEMENT; PROVIDING THAT SUCH ABANDONMENT SHALL BE THE INTEREST WHICH TIlE CITY MAY LEGALLY AND LAWFULLY ABANDON; PROVIDING TIIAT SAID ORDINANCE SHALL CONSTITUTE A QUITCLAIM DEED THAT MAY BE RECORDED WITH THE COUNTY CLERK OF DALLAS COUNTY, TEXAS; AND FOR PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Coppell finds that the following drainage easement is no longer needed for public purposes; and WIIEREAS, the abutting property owners desire that said drainage easement be abandoned and in consideration thereof has dedicated to the City of Coppell, Texas, an additional drainage easement which is needed by the city for public purposes; and WtIEREAS, the City Council of the City of Coppell finds that said property is a narrow easement and should be exchanged for such other easement to be ded|eated by the abutting property owners, William Thompson, Roy Brock, Louis Crump, Frank Bamburg, Ricl~ Oates, and Dr. and Mrs. Pat Evans. The abandonment provided for herein shall extend only to the public right, title and interest which the City of CoppeI1, Texas, may have in and to said drainage easaement, and shall be construed to extend only to such interest that the governing body of the City of Coppell, Texas, may legally and lawfully 'abandon. SECTION 4. This ordinance shall take effect immediately from and after its passage and approval by the Mayor of the City of Coppell, attested by the City Secretary, as the law in such cases provides.
