Dear Mr. Doyle: As per our telephone conversation of Monday morning, April 10, 1989, I called Mr. Caps to dete~ine the nature of his concern regarding the bridge and channel improvements currently being constructed as a part of the subject project at Grapevine Creek. He wanted to know if the limits of the channel improvements to Grapevine Creek would include any of his property and if there were any more trees to be removed from the north bank of the creek. My response to him was that the channel modifications extend only to the point at which the existing sanitary sewer aerial crossing intersects the north bank of the creek on his side, ana that the south bank of the creek would be modified to eliminate the "kink" in the creek bank a little upstream and across the creek from his property. Also there would not be any further clearing along the north bank of the creek under this project. Mr. Caps then asked if there was further clearing re~ired on the south bank of the creek. He was concerned that he would lose the current screening effect of the trees along the creek on the visibility of Denton Tap Road from his property. He also mentioned that he believed that the construction activities have caused cracks in the ground in his backyard, and that he is fearful of losing land and trees due to the resulting imminent collapse of the creek bank. I told Mr. Caps that since I was currently calling him from the project trailer, I would visit the site of his concern and call him back with my obse~ations. On my next trip down Denton Tap Road, I obse~ed the location of Mr. Caps' home in relation to the construction, and the apparent bank unde~ining along his property. Mr. Caps' property is located too far away from the construction activity associated with this project to be adversely affected in any physical way. The bank erosion along the rear of his property is, in my opinion, naturally occurring due to his property's location on the outside of a severe natural bend in the creek channel alignment. It appears that the recent sto~s have undefined the 17103 Preston Road · Suite 100 · LB 118 · Dallas, Texas 75248 · Phone 214/248-4900 creek bank along his property to the extent that one tree and part of a wooden split rail fence are both threatened with destruction as a consequence of any further flooding in the creek. None of this appears to be threatening his home or buildings, as there are no structures located very near the creek. None of the erosion damage I observed is attributable to the Denton Tap Road Improvements project. After returning to the project trailer, I called Mr. Caps and told him that there would be no further clearing work along the north bank of the creek and that there was still some clearing work and grading work left to do on the south side of the creek down to the bend in the channel. I also told him that none of the work associated with the project had contributed to the damage about which he was concerned. He asked who would be responsible for furnishing and installing erosion control/protection along the creek bank on his property. I responded that I did not know. Mr. Caps informed me that he would contact you by telephone and by certified letter to request your input regarding a solution to the bank erosion problem along his property.
