I met this morning with Shohre, Steve, ar~ Dale regarding the easement problem
brought to ou~ attention by Councilman Robertson.
Briefly, a deck extending out over a drainage easement had been built at 201 Penuel
with supporting members extending into the drainage easement. The next door neigh-
bor at 205 wants to build the same type of deck, has been advised by the City that
encroacbnent into the drainage area may be involved, and procurement, of a building
pe~rnit is conditioned upon more study, information, and possibly an extended evalua-
~c~o~ ti~-= period. Councilman Robertson expressed frustration that the City would
allow one deck structure to be built pretty straight-forward (201), yet now needs
~Dre study on one next door which is, essentially, the sa~ne product.
The City's concerns relate to encroachment, our ability to maintain the easement,
potential liability, our desire to not create another Jones problem, and process
followed to resolve the issue.
After much discussion and further rese~Lrch, we find that the drainage easement w~s
reduced from 30 feet to 15 feet by Council action on December 12, 1989 (doctrm~ntation
enclosed). Upo---n visual observation by Dale Jackson, it appears the proposed structure
at 205. (lot 36 on attached map), will be less of a potential problem than originally
thought. Shohre is reviewing all information regarding this proposed construction
amd understands the urgency of this issue.
We all agreed 'that if permission to encroach upon the drainage easement can be acccm-
modated Jn this instance, a hold-harmless letter should be obtained fr~m owners of
lots 36 ~u~d 37, and a time-driven review process should be instituted. We are pro-
ceeding with developing a review policy as this request is being expedited.
