Determination : PLAN REVIEW - COMPLETED

Enclosed are the results of the plan review completed on the referenced facility.
Identified on the report are areas of nonconformance with the accessibility standards
adopted by the Texas Department of Licensing and Regulation for purposes of ensuring
compliance with the Texas Government Code, Chapter 469.
Although deficiencies may have been noted, the referenced project may be
eligible for inspection approval if constructed in accordance with the 2012 TDLR/Texas
Accessibility Standards. Items which are the responsibility of the property owner should
be referred to the appropriate person for action.
The building or facility owner must request an inspection from BARRIER FREE TEXAS. L.L.C.
or another registered accessibility specialist (RAS) no later than fhirty (30) days after the
completion of construction. If the completion date provided on the Project Registration
Form (10/15/15) is no longer correct, please notify this office (in writing) of the revised
construction completion date as soon as possible.
This determination and plan review does not address the applicability of the Americans
with Disabilities Act (ADA) (P.L. 101-336) or any other local, state or federal requirements.

The plan review of these documents as contract documents by this registered
accessibility specialist approved by the State of Texas - TDLR is based on a best efforts
endeavor following certification by the TDLR. This plan review in No Way Warrants
complete compliance to the 2012 TDLR/TAS. THE FACILITY OWNER, TENANT AND THE
DESIGN PROFESSIONAL & EMPLOYEES/ENGINEERS FOR WHOM THIS PLAN REVIEW IS MADE
AGREES TO HOLD HARMLESS AND INDEMNIFY THIS REGISTERED ACCESSIBILITY SPECIALIST

AND THE TDLR FROM AND AGAINST ANY AND ALL LIABILITY WHICH MIGHT ARISE OUT
OF THIS WORK. IT IS THE INTENT OF THE PARTIES THAT THIS PROVISION SHALL SATISFY THE
REQUIREMENTS OF ALL RULES OR INTERPRETATION OF ANY APPLICABLE JURISDICTION
SPECIFICALLY INCLUDING BUT NOT LIMITED TO THE CLEAR AND UNEQUIVOCAL RULE,
EXPRESS NEGLIGENCE OR EXPRESS FAULT RULES, AND THE CONSPICUOUSNESS DOCTRINE,

Medians with Landscaping, 10' Public Trails, Curb Ramps,
Pedestrian & Bicycle Rails, Retaining Walls, Accessible Stamped
Street Crossings and Pedestrian Crossing Operating Controls.
