Box 478 Coppell, Texas 75019 The City With A Beautiful Future 214-462-0022 FAX 214 - 393-0948 January 6, 1995 (Letter mailed to 12 property owners) RE: Consideration of abandoning a portion of the drainage easement located on your property in the Creek View Subdivision 2- In December 1989 as the Creek View Subdivision was being developed, the developer and several home builders had an engineer perform a study showing that a portion of the drainage easement along the creek running between Glendale Drive and Penuel could be abandoned. At the December 1989 City Council meeting, Council approved an ordinance abandoning a portion of the drainage easement with the stipulation that the developers and homebuilders provide a replacement easement of a smaller width. Recently, the City Secretary brought to my attention that this action had never been followed through with and in fact even though Council acted on the ordinance, the ordinance had never been signed and executed. You may be under the assumption that a portion of the easement has already been abandoned and until recently that was the general assumption of the City. However, the original easement is still in place. On January 10, 1995, the City Council will be taking action to follow up on its 1989 action abandoning a portion of the easement. The abandonment has been written in a different format this time which does not require you, as a homeowner, to sign any documents. In effect, the City is only releasing a portion of its easement to you to use as you wish. With this letter, I am including a copy of the legal description and exhibit that shows the area the Council will be abandoning on your lot at the January 10th, 1995 City Council meeting. This item is on the consent agenda and the action should be just routine to rectify the 1989 action.
