Chadick Capital L.P. agrees to the City of Coppell's original offer to by ˗262˗ 675 sq. ft. of easement adjacent to the south side of the proposed gabion project (on 595 South Coppell Road) and allow the infill/ grading of the same property near the road easement and gabion area, as presented and described to me on July 9, 2014. We would ask in addition, that any direct or indirect damage done to the large pecan tree found closest to the proposed gabion project become the responsibility of the City of Coppell. This would include damage done to the tree by grading and gabion construction work--including the severing of large roots that could possibly weaken or cause the later demise of the tree, direct damage from the use of construction related machinery, or the addition of fill dirt around the base of tree that may impact the tree's longevity in future years. The City would therefor agree to the removal of said tree, due to the aforementioned reasons that would cause its demise, in the future. If it is deemed that this provision cannot be granted, whether in an amended form or not, then we desire that the City to take full responsibility for the removal of said tree from the property from the onset so this does not become an issue in the future.
