My thoughts are in line with Rick’s. I’ve reviewed comments below from
Mr. Smith and Mr. Doyle regarding the interpretation of the contract
documents and offer the following:
* TNP Response
o It’s unfortunate that TISEO (or sub) did not catch this during the
bidding phase.
o The description of pay Item I-197 actually states the following
* “This work includes the furnishing, installing, and planting of all
landscape improvements as shown in the construction plans in accordance
with applicable items in the NCTCOG standard specifications, the
Technical Specification included in these contract documents.”
* “Measurement and payment for the work performed and materials
furnished related to the installation of landscaping shall be on the
basis of price bid per lump sum (LS) and shall be the total compensation
for furnishing all labor, materials, equipment, and incidentals
necessary to complete the work in place and accepted.”
* The bridge median paving is decorative and is an integral component
of the landscaping design of the median islands. As such details were
specifically provided on the landscape plans.
* As the item was bid lump sum the contractor is responsible to
account for all elements provided in the landscaping plans.
o The limits of the stamped concrete for Pay Item I-28 were reflected
in the paving plan sheets 12-18 as well as referenced to the City
standard details 2130 and 2190 in the specifications. None of the
decorative landscape pavement (neither the median or mow strip bands)
were reflected on these sheets.
o It should be noted that concessions have been made to eliminate the
mow band strip per the original design in an attempt to facilitate ease
of construction yet maintain the intent of the overall landscaping
design elements.
We can provide a detail for the median paving on the bridge but agree
that the previous direction regarding doweling of the curb should be
disregarded in lieu of providing the expansion joint. I’ll follow up
with additional information. Additionally, as noted in our 10/13
response, we provided additional direction regarding joint
spacing/coordination including the following:
1. The contractor should honor both the existing expansion joints
in the bridge/abutment (e/w).
2. The contractor shall provide adequate reinforcing and control
joints as required per City standard details.
3. A control joint should be provided at the end of the bridge
approach slabs/ roadway pavement tie-in where the section of median
patterned pavement is located on both the bridge deck and soil section.

Basically they are asking for $14,681.61 for something that they should
have caught. If we pay the stamped price for stamped and the trail price
for broom finished concrete we would pay $9,707.67, that's a difference
of $4973.94 to our benefit if we agree to pay anything. I'm surprised
they didn't include 2 extra weeks in their proposal .

Keith,
After reviewing the contract documents and discussing the median
paving issue with our estimator, landscape, flatwork and bridge
sub-contractors it is apparent that the median paving shown on the
bridge section was not included in any of our bids. Although the median
paving is shown on the landscape plans it was unclear at the time of bid
that the intent of Item I-197 was to include median paving. The item
simply states that it includes furnishing, installing and planting all
landscape improvements. Concrete median paving is not typically
considered a landscape improvement. At least the first time we have seen
it included as such.
We have pay item I-28 6” Stamped Concrete Pavement and a portion
of the median paving is stamped however no pay item exists for the
light/heavy broom finished portions of the median. I realize this should
have been a red flag at the time of bid and clarification should have
been requested at that time unfortunately this was an oversight and now
we are asking the City to consider payment. The area totals 214 SY and
we would like the City to consider paying this quantity under our
existing contract Item 28 6” Reinforced Stamped Concrete Pavement.
In addition we do need a detail or other clarification with
regard to placing the median pavement on the bridge deck. The comments
below from TNP indicate that we should follow the City standard details
but I have not found a standard detail for placing stamped median paving
or mow strips on a bridge deck. In the field we have discussed various
options and it is my understanding that the City would prefer placing a
bond breaker (felt paper) between the deck and the paving vs. any
attempt to dowel in. We would also expect to place expansion joint
material between the median paving and back of curb. Please let us know
if there are any other requirements that need to be met.

Nowhere was it clear that the concrete work on the bridge was
subsidiary to the landscape bid. I do not know a single landscape
company that does colored concrete nor do I know of one that would
assume it to be part of a landscape companies scope. Why would it be
when all the other paving is a pay item? It specifically calls out
"installation of LANDSCAPING" in the pay item description. Not
hardscape, paving, or flat work. It specifically states "this work
includes the furnishing, installing, and planting of all LANDSCAPING
IMPROVEMENTS - not paving improvements. It mentions nowhere that paving
is to be included in the landscape.

a. The contractor should honor both the

c. A control joint should be provided at
the end of the bridge approach slabs/ roadway pavement tie-in where the
section of median patterned pavement is located on both the bridge deck
and soil section.
FYI per City Standard Detail 2130, the median
pavement is shown to be doweled into the back of curb with #4 X12 “ @
18” O.C.
2. Pay Item
a. The following sheets reference the
median pavement
* Sheet 03 Typical Sections
– contains the following note for the bridge section “stamped concrete”
in reference to the median pavement.
* Sheet 69 Typical Bridge
Section & Details – contains following note “SEE LANDSCAPE PLANS FOR
DETAILS” in reference to median treatment on the bridge.
* Sheet 85 Miscellaneous
Slab Details – contains following note “SEE LANDSCAPE PLANS” in
reference to median treatment on the bridge.
* Sheet 116 Landscape Plan
65+50 – 69+50 provides specific details/quantities for the median
pavement design (±1929 sf).
b. All of the landscape elements for this
project were bid lump sum (LS). Other than the references previously
noted, the details for this work were provided on the Landscape sheets
and should have been accounted for as such in the contractors pricing
for the project.

Gentlemen,
We met with Tiseo and their bridge subcontractor
today to discuss several issues regarding the bridge. One issue that
they are concerned about is the decorative paving in the median. Some
of their concerns are:
1. The potential movement of the
bridge from flexing or expansion/contraction damaging the multiple
pieces of different concrete called for in the plan.
2. There does not appear to be a pay
item in the project for this decorative concrete.
Any thoughts on either of these issues?
