We ]lave reviewed thi~; p=oject in accordan~:e with Section
404 c.,f t~]c Clean Water Act.. Under Section 404, the U.S. Army
Corps of Engineers regulates the discharge of dredged and fill
material into waters of the Un~ted States, including wet. lands.
Based oil your' description' of the proposed woz'k, arid other
information available to us, we have determ~.ned that this
project will involve activities subject to the requirements of
Sect.~on 404. Thez'efore, it will require Department of the Army
authorization.
We have determined that th~s project continues to meet the
scope of work authorized by nationwide permit 26 which allows
discl~a~'.~e of dredge or fill materials into non--tidal rivers,
streams, at]d %hei~ lakes and impoundments, including adjacent
wetlands provided the activity does Dot caus~ the loss or
substant~a~ adverse modification of one or more acre~ o£ waters
of the United States.
