There has been no recent zoning or platting history on the subject
tract although the applicant postponed this case from our
November and January Planning Commission dockets in an attempt
to address staff concerns.
Denton Tap Road is a P6D, six-lane divided thoroughfare built to
standard within a 120 foot right of way.

COMPREHENSIVE PLAN:
The Comprehensive Plan shows the property as suitable for
mixed commercial/retail uses.
DISCUSSION:
Although we had several concerns with this application when first
submitted in November of 1998, the applicant has diligently worked with
staff to overcome a number of problems including site design, parking
location, signage, building elevations, and landscaping requirements.
Staff is comfortable with the current site layout. The submitted landscape
plan does for the most part conform to city regulations. The only
exception pertains to the 1,071 sf of right-of-way planting that will be
accepted to satisfy part of the required landscaping. Typically sidewalks
are located 1 foot off the street right-of-way. As Denton Tap Road is a
major thoroughfare, staff would like to discourage the construction of a
sidewalk against the back of curb. As shown, the sidewalk is located
within the applicant's property line, and staff is amenable to modify the
landscaping requirements to obtain a safer streetscape design. The
applicant will have to include the right-of-way planting information under
the Site Data section shown on the Site Plan, as well as verify that the Site
Data information matches the Landscape Data shown on the Landscape
Plan.
The building elevations were modified to address the recommendations of
the CIVIC report. Both the face brick and accent face brick are earth-
toned (Acme Brick/Delta Queen//6556, Modular: Elgin Plant). The base
of the building is shown to be a "Limestone", split face CMU. The
awnings over the windows will be canvas. The color selected is a single
deep muted red color to complement the brick (Berridge Satin Finish,
Galvalume). The two metal roofs over the two entrances are shown to be
a lusterless metal in a burgundy color. The color elevation provided by
the applicant shows a muted red channel letter sign that will complement
the cho. sen brick. However, the sign elevation prepared by the Banner
Sign Company shows a yellow channel letter sign that is outlined by red
neon. Staff is of the opinion that the muted red channel letter sign is more
in line with the recommendations of the CIVIC report, and neon is not
allowed under any circumstance.
The sizes of the proposed attached signs have been of concern to staff.
However, with this submittal, the applicant has provided a sign that shows
the "Dickey's Barbecue Pit" sign to comply with City Code. Based on the
total width of the front fagade of the building, the applicant is allowed a
maximum of 47 square feet. Therefore, the shorter "Dickey's" sign over
one of the entrances must be eliminated, or the "Dickey's Barbecue Pit"
sign must be reduced.

RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION:
The planning staff recommends approval of the special use permit
subject to the following conditions being met:

Modify the Site Data information on the Site Plan to match the
Landscape Data on the Landscape Plan.
The Landscape and Irrigation Plan should be signed and sealed
by the appropriate professional. ,
Eliminate the "Dickey's" sign over the entrance to the building.
Limit total signage to 47 square feet and the color of sign to a
muted red; no neon allowed.
Approve submitted building materials and specify in the
ordinance.
