RE: Consideration and approval of an ordinance to abandon portions of various utility
easements located within the Creekview Subdivision.

In December, 1989, City Council approved an ordinance abandoning an existing drainage
easement in Creekview Subdivision with the condition that a new 15 foot drainage easement be
dedicated to the City of Coppell to replace the abandoned easement. Recently, the City
Secretary brought to my attention that the 1989 ordinance was never executed by the City.
Upon investigation, it was noted that the condition for the rededication of a new easement was
never complied with, therefore, the original ordinance abandoning the easement could not be
executed. In the original abandonment there were five home builders and one property owner
that would have signed the new easement to the City of Coppell. Because over five years has
now passed, the builders are no longer involved in the development of Creekview and the
property owners are unaware that the abandonment has never taken place. In fact, we have been
contacted by several property owners under the assumption that the abandonment did take place.
To eliminate the need for the City to acquire a new easement, the Engineering Department has
taken each individual lot and prepared legal descriptions for just the amount that was to be
abandon i.e., the difference between the original easement and the new easement that was to be
dedicated to the City. By preparing the ordinance this way, the property owners do not need
to sign and/or grant anything to the City. The City is only giving up it's rights to the excess
drainage easement and the property owners can then utilize the abandoned portion of the
easement anyway they see fit.
Based on previous studies, the City has no need for this easement and Staff recommends the
approval of the ordinance to abandon the excess portion of the drainage easements in Creekview
Addition. Staff will be available to answer any questions at the Council meeting.

WHEREAS, the City Council of the City of Copper has determined that the portions
of utility easements described in Exhibits "Al" through "Al2" and "BI" through "B12"
attached hereto, are no longer needed for City services; and
WHEREA~, the City Council of the City of Copper has determined that the interest
of the City and the public therein should be abandoned; and
WHEREAS, the abutting property owners desire that such portions of the easements
be abandoned; and
WHEREAS, the City Council of the City of Copper has determined that the City and
public have no need for such portions of the easements, and that the cost of keeping and
maintaining such portions of the easements is in excess of the fair market value of the City's
interest in the easements being abandoned;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF COPPELL, TEXAS:
SECTION 1. That the City Council of the City of Coppell, Texas has
determined that the portions of utility easements described in Exhibits "Al" through "Al2"
and "BI" through "B12", attached hereto and made a part hereof for all purposes, are no
longer needed or necessary for public purposes and should be abandoned in favor of the

twelve abutting property owners, identified in Exhibit 'C", attached hereto and m~de a part
hereof for all purposes.
S~ON 2. That the City of Coppell, Texas, hereby abandons all its right, rifle, and
interest in and to said portions of easements, and abandons, conveys, and relinquishes all
such public interest the City may have in and to said portions of easements to the twelve
abutting property owners.
SECHON 3. That the City Council of the City of Coppell, Texas, has determined
that the cost of keeping and mnintalRing such portions of tho easements is in excess of the
fair market value of the City's interest in the portions of the easements being abandoned.
SECTION 3. That the abandonment ordinance of the City's interest in said portions
of easements shall constitute a Quitclaim Deed in favor of the twelve abutting property
owners, and a certified copy of the same may be filed in the Deed Records of Dallas
County, Texas, to indicate such abandonment.
SECTION 3. That the abandonment provided for herein shall extend only to the
public right, rifle and interest which the City of Coppell, Texas, may have in and to said
portions of utility easements, and shall be construed to extend only to such interests that the
governin~ body of the City of Coppell, Texas, may legally and lawfully abandon.

as the law and charter in such cases provide.

described as follows:
COMMENCING at a point common to the Southeast comer of Lot 41, the Northeast comer of

THENCE departing from the West property line of LOt 34, following the common property line of
