This letter is written as a follow up to your February 20, 1996 proposal to the City to provide
geotechnical services for the construction of the Village Parkway Pump Station addition, your
March 12, 1996 letter to Mr. Mike Daigre of North Texas Municipal Construction Co.
concerning the testing and our April 15, 1996 telephone conversation. As you may recall, the
City has requested a letter be submitted or an acknowledgement be provided from Mr. Mike
Daigre concerning his understanding of the testing requirements and his obligation to pay for any
testing outside the scope of services provided by your fn'm.
The Village Parkway Pump Station project is proceeding and shortly testing will be required
to ensure that this project moves smoothly. I am again requesting that the acknowledgement be
provided so that we can sign your proposal so you can proceed with necessary testing. Please
provide this information as soon as possible.

Confirming our discussiou of March 7, 1996, we are pleased to provide construction materials testing
services that you request for the above referenced project. The enclosed proposal addressed to the
City of Coppell briefly outlines our understanding of the services to be performed.
The fees for the various items of testing will be at unit rates; whereas, lhe inspection services,
sampling charges, etc., will be doue at the appropriate hourly rate. A schedule of these fees is
included for your file. As discussed during our telephone conversation and at the project pre-
construction meeting, services performed on over-time (Mondays to Fridays before 7:30 am and after
5:00 pro, Salurday and Sunday) are to be paid for by the contractor. Field inspection hourly rates
are charged ou a portal to portal basis. In addition, any testing performed as retests or for your
use/conveuieuce would be paid for by your firm.
Also, enclosed is a copy of our standard "Agreenxent for Materials Engineering and Related
Construction Inspection and Materials Testing Services". Please sign and rcluru (1) copy for our
files. Your signature of acceplance will confirm the agreement for the services requested.

Dear Mr. Gee:
On behalf of the City of Coppell, we have reviewed your proposal dated February 1, 1996, for materials testing and
inspection for the Village Parkway Pump Station Addition. We recommended the City accept your proposal with the
following exceptions:
1. Section VI of the materials testing proposal should be deleted. The concrete slabs for the package
chlorine/ammonia scrubber slabs are existing and will not require further testing. Deducting the $543.00
inspection and testing charges for the scrubber slabs will change the total for all inspection and testing services to
$4,327.25.
2. This proposal has no provisions for overtime charges. We offer no objections to this, provided Gee Consultants,
Inc. understands the City will not pay for overtime. The project specifications state that the general contractor
for the construction of the pump station is responsible for overtime charges related to inspection. It is our
interpretation that this also applies to inspection and testing services provided by the City when using an outside
consultant.
The subject of overtime was discussed in the pre-construction conference for the project held on February 6, 1996.
We believe we made it clear to both you and the general contractor, North Texas Municipal Construction Company,
Inc., that any overtime charges incurred on this project shall be billed directly to the general contractor.
We have been directed by the City to forward these review comments to you and request that you submit a revised
proposal. If you have any questions or need additional information, please do not hesitate to contact us.

Dear Mr. Griffin:
We have reviewed Exhibit "A", dated February 1, 1996 of Gee Consultants, Inc. for materials testing and
inspection for the Village Parkway Pump Station Addition and believe the proposal is acceptable with the
following comments.
1. Section VI in the enclosed testing proposal should be removed because the package chlorine/ammonia
scrubber slabs are in place. Deducting the $543.00 inspection and testing charges for the scrubber slabs
will change the total for all inspection and testing services to $4,327.25.
2. This proposal has no provisions for overtime charges. We offer no objections to this, provided Gee
Consultants, Inc. understands the City will not pay for overtime. The project specifications state that the
general contractor for the construction of the pump station is responsible for overtime charges related to
inspection. It is our interpretation that this also applies to inspection and testing services provided by the
City when using an outside consultant.
This subject was discussed in the pre-construction conference for the project held on February 6, 1996.
We believe we made it clear to both Gee Consultants, Inc. and the general contractor, North Texas
Municipal Construction Company, Inc., that any overtime charges incurred on this project shall be billed
directly to the general contractor.

Our total estimated fee to perform the aforementioned tests and services is $4,870.25. It should
be noted that this proposal is based on the estimated number of tests and quantities mentioned
in this proposal and not a lump sum price. The construction sequence or job conditions may
require more or fewer testing or inspection. Only work which is actually performed will be
charged for and all charges will be in accordance with the corresponding unit fees quoted in this
proposal or our Schedule of Fees.
We understand we have been selected for this project and, therefore, when providing this
estimate, are not in violation of laws governing procurement of professional engineering
contracts with public entities.

require more or fewer testing or inspection. Only work which is actually performed will be
charged for and all charges will be in accordance with the corresponding unit fees quoted in this
proposal or our Schedule of Fees.
We understand we have been selected for this project and, therefore, when providing this
estimate, are not in violation of laws governing procurement of professional engineering
contracts with public entities.
