RE Railroad Flagging ChargesMarty,
I'll bring your issues to the attention of FWWR, but it may be too late to change anything. My understanding is each of these charges corresponds to a day than an employee of JRJ called
and requested a flagman.
I do want to point out that while you do not have a contract with FWWR, you do have one with the City of Coppell that stipulates the contractor is responsible for railroad coordination.
We will need to come to a resolution that is satisfactory to the railroad before we can close out the project.

I have received and reviewed the invoices from FWWR for the flagging
charges. And as I suspected they are trying to charge me a minimum of
eight hours every day they show up. They only worked one day that was a
full eight hours the rest were four hours or less. I am also being
charged for one day when we had to cancel due to weather.
This guy sits on this railroad all day long and comes by periodically to
check on us so it is not like had to travel to get here. All projects
that we have done previously requiring flaggers required we pay a
minimum of four hours, not eight. I do not have a contract with FWWR
where I have committed to pay for an eight hour minimum or we would have
scheduled their assistance differently. I am not going to pay these
ridiculous charges as invoiced. I will pay for the one day they work a
full eight hours and the remaining days will be paid at the minimum four
hours excluding the one cancellation day where they were given ample
notice due to inclement weather.

I have received 2 calls this week from Fort Worth & Western Rail Road
concerning unpaid flagging charges on the South Coppell Road project.
The invoices for this work were forwarded to JRJ for payment.
Under the terms of JRJ's contract with the City of Coppell, JRJ is
responsible for coordination with the railroad for all necessary
shutdowns, and to provide flagmen when necessary. Please respond to
these invoices in a timely manner.
